A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A 25 FOOT UTILITY EASEMENT ALONG THE WEST SIDE
OF THE CITY PROPERTY ON SOUTH RAZORBACK ROAD WHICH IS
THE PROPOSED SITE OF A SOLID WASTE RESOURCE RECOVERY
FACILITY. UTILITIES INSTALLED IN CONJUNCTION WITH THIS
EASEMENT WILL BE SUBJECT TO RELOCATION, IF NECESSARY, AT
THE CALL OF THE CITY AND AT NO EXPENSE TO THE CITY.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and directed
to execute a 25 foot utility easement along the west side of City
property on South Razorback Road which is the proposed site of a
solid waste resource recovery facility. A copy of the easement
authorized for execution hereby is attached hereto, marked Exhibit
"A" and made a part hereof.

A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A 25 FOOT UTILITY EASEMENT ALONG THE

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a 25 foot utility easement along the west
side of City property on South Razorback Road which is the
proposed site of a solid waste resource recovery facility.
A copy of the easement authorized for execution hereby is
attached hereto, marked Exhibit "A" and made a part hereof.

EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That the undersigned grantor for the consideration of
($ 1.0I ),and other good and valuable consideration to it in
by
the City of Fayetteville, Arkansas, a municipal corporation,

grantee, a receipt of which is hereby acknowledged, does hereby grant,
bargain, sell and convey to the City of Fayetteville, Arkansas, a
municipal corporation, and to all public utility companies (including
cable television companies) providing utility service within the City
of Fayetteville, the following described perpetual easement for the
purpose of constructing, maintaining, repairing and replacing public
utility lines (including cable television lines), to -wit:
A permanent easement of 25 feet of equal and uniform width off the entire west side
of -the following described real estate.
A tract of land situated in the NE 1/4 of the NE 1/4 of Section 20, T -16-N, R -30--W
of the 5th Principal Meridian, being more particularly described as follows, to wit:
Beginning at a point which is 1318.36' West and 266.5' S 00 07' West of the NE corner
of the above described quarter quarter, thence N 00 07' E 266.5', thence East 823.36'
thence S 00 07' W 266.5', thence West 823.36' to the point of beginning and containing
5.04 acres, more or less.
A tract of land situated in the NE 1/4 of the NE 1/4 of Section 20, T -16-N, R -30-W,
of the 5th Principal Meridian, being more particularly described as follows, to wit:

of the above described quarter quarter, thence East over the centerline of an existing

UTILITIES INSTALLED IN CONJUNCTION WITH THIS EASEMENT WILL BE SUBJECT TO
RELOCATION, IF NECESSARY, AT THE CALL OF THE CITY AND AT NO EXPENSE TO
THE CITY.
TO HAVE AND TO HOLD said premises to said grantees for the uses and
purposes hereinbefore described.
Grantor covenants that no buildings or structures, other than fences,
shall be erected on said easement.
