A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN EASEMENT GRANTING SOUTHWESTERN BELL TELEPHONE
COMPANY THE USE OF A -TWENTY FOOT BY THIRTY FOOT AREA
ALONG THE NORTH EDGE OF GREGORY PARK TO INSTALL A
REPEATER STATION.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute the easement attached hereto, marked
Exhibit "A" and made a part hereof.

REPEATER EASEMENT
In consideration ofthe sum. of $350.00 Dollars, receipt
of which is hereby acknowledged, the City of Fayetteville,
Arkansas, hereby grants to the Southwestern Bell Telephone
Company, a Missouri Corporation., its associated and allied
companies, their respective successors, assigns, lessees
and agents an easement to construct, reconstruct, operate,
maintain, enlarge, and remove a Repeater Station, consisting
of repeater apparatus and enclosing structure or housing,
upon a plot of ground twenty (20) feet wide, and thirty (30)
feetlong, upon the following described property owned by the
Grantor and situated in the County of Washington, State of
Arkansas, to -wit: Part of the NE4 of the NE; of Sec. 9,
T -16-N, R -30-W, a strip of land in Gregory Park of the City
of Fayetteville, Washington County, Arkansas, and the Grantee
may from time to time, as the Grantee may require, connect
said Station by means of cable and other equipment and fixtures,
with the Grantee's communication systems located on said

easement and adjoining public right of way, together with the
right of ingress and egressto and from said Station; to
install gates in any fences crossing said roadway; and to
clean and keep cleared all trees, roots, brush, and other
obstruction from said plot; to donecessary grading to make
ground suitable for Repeater Station; and to erect and maintain
a protective fence around station on said plot. The boundary
of said plot shall be South side of Sycamore Street and West
side of an extension of Woodland Street. A permanent easement
of 20 feet in width and. running West a distance of 30 feet
described as follows, to -wit: Beginning at a point in Gregory
Park, said point being 332 feet West of the Northeast corner
thereof and running thence South 20 feet, thence West 30

feet, thence North 20 feet, thence East 30 feet, to the point
of beginning.
As a condition to the granting of this easement, grantee
shall be required to plant and maintain vegetation screening
any repeater.•appar.atus and enclosing structure or housing
placed on said easement from public view at all times. Should
grantee at any time fail to comply with this condition, the
easement granted hereby shall terminate and grantee shall
remove its facilities from grantor's property.
