A RESOLUTION EXPRESSING TO THE FAYETTEVILLE PLANNING
COMMISSION THE CONCERN OF THE FAYETTEVILLE BOARD OF
DIRECTORS THAT ADEQUATE DRAINAGE IMPROVEMENTS BE INSTALLED
AT SUCH TIME AS THE MARINONI PROPERTY LOCATED SOUTH OF
ARKANSAS HIGHWAY 16 WEST (WEDINGTON DRIVE), WEST OF
LONNIE AVENUE, IS DEVELOPED.
WHEREAS, the Fayetteville Planning Commission has
approved a conditional use permit for the construction of
duplexes on a 2.51 acre tract owned by Paul Marinoni, Sr.
and Located on the. South side of Arkansas Highway 16 West
(Wedington Drive), West. of. Lonnie Avenue; and
WHEREAS, the Fayetteville Planning Commission and the
Fayetteville Board of Directors have approved the rezoning
of a 2.,T. ---acre tract having the same owner and location from
R-1, low density residential district, to R-0, residential
office district; and
WHEREAS, the Fayetteville Planning Commission and the
Fayetteville Board of Directors have approved the rezoning
of a 124'acre tract having the same owner and location from
R-1, low density residential district, to R-2, medium density
residential district; and
WHEREAS, the Board of Directors has determined that
potential surface drainage problems on the aforesaid three
tracts may occur and affect surrounding property when develop-
ment occurs if adequatestorm drainage facilities are not
constructed by the developer; and
WHEREAS, the developer of the aforesaid three tracts
must submit a development plan for approval by the Planning
Commission before undertaking development; and
WHEREAS, as a condition of approval, the Planning.
Commission can require the developer to install necessary
storm drainage facilities.
NOW, THEREFORE., BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby requests the Fayetteville
Planning Commission to require the developer of the aforesaid
three tracts to install any necessary storm drainage facilities
necessary to prevent creating or compounding a surface
drainage problem on said property or in the abutting area.
AND APPROVED this 6th day of December, 1983.
