RESOLUTION NO. 139-83
A RESOLUTION REQUESTING'-THEFFAYETTEVILLE PLANNING
COMMISSION TO AMEND THE FAYETTEVILLE PARKS PLAN TO
COMPLY WITH THE DECISION OF THE ARKANSAS SUPREME
COURT IN CITY OF FAYETTEVILLE V. IBI, INC.
WHEREAS, the Arkansas Supreme Court ruled..on.October 31,
1983, in the case of City of Fayetteville v. IBI, Inc. that
the Fayetteville Parkan is not sufficiently definite; and
WHEREAS, the Board of Directors has determined that the
provision of adequate parks is essential to the public welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby requests the Fayetteville
Planning Commission to prepare and submit to the Board of
Directors ant amendment to the Fayetteville Parks Plan so as
to comply with the decision of the Arkansas Supreme Court in
,City of Fayetteville v:. IBI, Inc.
1983.
