A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A JOINT USE AGREEMENT WITH THE UNITED
STATES OF AMERICA FOR THE EXPANSION OF A PARKING
LOT ADJACENT TO WALKER PARK NORTH.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKNASAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a joint use agreement with the United
States of. America for the expansion of a parking lot adjacent
to Walker Park North. A copy of the joint use agreement
authorized for execution hereby is attached hereto, marked
Exhibit "A" and made a part hereof.

This is in regard to the Joint Use Agreement in connection with NOy(R)-
53029 covering expansion of the parking lot of the Naval Reserve Facility,
Fayetteville, Arkansas.
The Joint Use Agreement has been executed on behalf of the Government, and
a, completely signed copy is enclosed for your permanent records.
Your cooperation and assistance in making this property available for
Government use are appreciated.

JOINT USE AGREEMENT
This Agreement executed this 6th
•
day of September , 19 83, by and
between the City of Fayetteville, Arkansas, hereinafter called "Lessor," and
the United States of America, hereinafter called "Lessee."
WHEREAS, Lessor executed a Lease of Real Property, NOy(R)-53029, on
February 24, 1958, under which the real property described therein is leased
to Lessee for a period of ninety-nine (99) years ending March 1, 2057; and
WHEREAS, a United States Naval Reserve Facility and paved parking lot is
located on said property; and
. WHEREAS, Lessor proposes to expand said paved parking lot as well as pave
an adjacent area owned by the Lessor for use by patrons of Walker Park; and
WHEREAS, Lessee has agreed to joint use of said entire expanded parking

lot including the paved parking lot on property owned by Lessor, by members of
the United States Naval Reserve and by patrons of Walker Park.
NOW, THEREFORE, Lessor and Lessee hereby agree as follows:
1. Lessee hereby grants Lessor permission to expand the parking lot
pavement located on the real property leased by the Lessee at no expense to
the Lessee and described in Exhibit "A" attached hereto and made a part hereof.
2. Lessee hereby agrees that said parking lot, as expanded by Lessor,
may be used by patrons of Walker Park, provided, however, that the Lessee
shall have priority use of the expanded parking lot on the leasehold described
in Exhibit."A" during military drills. Should it become necessary in the
opinion of the Lessee, the Lessor shall erect at Lessor's expense any access
control measures to ensure Lessee's priority.
3. This Agreement shall be in full force and effect during the term of
the Lease NOy(R)-53029, and any extension or renewal of said Lease.
IN WITNESS WHEREOF, the parties have executed this Agreement on the date
first above written.
