A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO'EXECUTE A CONTRACT WITH LEONARD KELLY AND BILL
KELLY d/b/a LEONARD AND BILL KELLY CONSTRUCTION
FOR THE PROVISION AND INSTALLATION OF BASE MATERIAL
FOR THE INTERIM CITY ADMINISTRATION BUILDING.

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute a contract with Leonard Kelly and`Bill`
Kelly d/b/a Leonard and Bill Kelly Construction for the.
provision and installation of base material for the interim
City Administration Building. A copy of the contract authorized
for execution hereby is attached hereto and•marked Exhibit "A"
and made.a part hereof.

Bids were opened on the above date for hauling, spreading and compacting
hillside base to raise the ground level grade to within eight inches of
finished floor elevation on the Interim City Hall at 115 S. Church. A
copy of the sepcifications for this work was approved by the Architects
prior to advertisement for bids.
Since time is of the essence on the work it is recommended that the low
bidder, Leonard and Bill Kelly Construction Company,be authorized to
begin work immediately in conjunction with the work of the General
Contractor so'tthat construction will not be held up until the next City
Board meeting.
The City Attorney, Jim McCord, has been asked to perfect a unit price
contract for this work, which contract will be on the City Board Agenda
of May 18, 1982 for authorization for the Mayor...and:City Clerk to
execute the Agreement and to ratify the award of this bid effective
May 5, 1982.
A copy of the bid specifications is attached.

NOTICE TO PROSPECTIVE BIDDERS
Request for Written Quotations
FOR: Hauling, filling and compacting hillside base material at 115 S. Church
Street in accordance with the specifications spelled out herein and in
accordance with the plans attached.
Hillside base fill material shall be hauled, spread and compacted toat least
95% of modified proctor. All fill material shall be hand compacted Three (3)
to Four (4) feet on the inside and outside of the building foundation. All
fill material is to be spreadand compacted in Eight (8) inch lifts until
all fill material is to within Eight (8) inches of finished floor elevation
in accordance with the plans. The method of spreading and compacting the fill
material in Eight (8) inch lifts shall be done concurrently with foundation
and stem wall construction. This process shall continue until the fill material
is compacted to within Eight (8) inches of finished floor elevation. All
work is to be continuously coordinated with Mr. Dick Larson, Job Superintendent
for the General Contractor, Mcfurtrey-Cullers Construction Company of Springdale,
Arkansas; Phone 751-8494. Any questions are to be resolved by the Architect,
Mr. Don Froning of Hailey, Powers, Froning Architects, Ltd.; Phone 442-5565.
Around and within the building area (approximately Three (3) feet outside of
each foundation wall) will require approximately 900 cubic feet of fill material -
Beginning at the north foundation line and running north, east and west to the
edge of the parking area, there will be approximately 450 cubic feet of fill -
material. All fill material is to be compacted to at least 95% of modified
proctor.
All bids must be submitted in writing to ;the Purchasing Officer, Sturman Mackey
by 10:00 A.M. on Wednesday, May 5, 1982.
Bids are to be submitted on a per cubic yard basis and this bid shall be good
and firm for all fill material over the entire project a4 -a

General Public Liability Insurance, Property Damage Insurance, And Workmens
Compensation Insurance shall be carried on this job. Certificates evidencing
this coverage shall be filed with the City Purchasing Officer prior to the
beginning of any work by the winning bidder. Minimum: $50,000: $50,000:,
$50,000; and workmens compensation as required.

CONTRACT
This Contract executed this �, day of
1982, between the City of Fayetteville, Arkansas,
hereinafter
called the City, and Leonard Kelly and Bill Kelly d/b/a
Leonard & Bill Kelly Construction, hereinafter called the
Contractor.
In consideration of the mutual covenants contained
herein, the parties agree as follows:
1. The Contractor shall haul, fill, and compact
hillside base material for that property at 115 South Church,Avenue,
in the City of Fayetteville, Arkansas, on which an interim
City Administration Building is to be constructed. All work shall
be in accordance with the plans and specifications for said
interim Administration Building prepared by Hailey, Powers,
Froning Architects, Ltd. which plans and specifications are
incorporated herein by reference thereto. The Contractor
shall commence work immediately upon execution of this contract.
2. The Contractor shall provide all equipment, labor,
and materials required for the construction of the above-
described.interim.Administration Building.
3. The City shall pay the Contractor $7.00 per cubic
yard of fill material actually; used by Contractor under the
terms of this contract: The number of cubic yards to be
used is estimated at 1,350. Said consideration shall be
payable to Contractor in a lump sum upon completion of the
above-described interim Administration Building and acceptance
thereof by the City.
.4. The Contract documents which comprise the contract
between the City and the Contractor consists of this
Contract, the architects' plans and specifications for the
interim .City Administration Building, and the following
documents attached hereto and made a part hereof:

(a) Request for Written Quotations dated
April 29, 1982.
5. The Contract documents constitute the entire
agreement between the City and the Contractor and may be
modified only by a duly executed written instrument signed
by the City and the Contractor.
6. .The Contractor shall not assign his duties under
the terms of this agreement.
7. The Contractor shall at all times maintain in
full force and effect the following insurance:
(a) Workmen's compensation insurance as required
by Arkansas law.
(b) Public liability insurance with such company
and in such amounts as are Approved by the'City. ,
8. The Contractor agrees to hold the City harmless,'
and indemnify the City, against any and all claims for property
damage, personal injury or death, arising
