A" RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO INSTITUTE EMINENT DOMAIN PROCEEDINGS
TO CONDEMN A UTILITY EASEMENT AND STREET RIGHT OF
WAY ACROSS CERTAIN PROPERTY OWNED BY DAVID RANDLE
AND JEANNE RANDLE FOR THE PURPOSE OF CONSTRUCTING
IMPROVEMENTS TO NORTH STREET.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the City Attorney is hereby authorized and directed
to institute eminent domain proceedings to condemn the utility
easement and street2right of way described in Exhibit "A"
attached hereto and made a part hereof across property owned
by David Randle and Jeanne Randle for the purpose Of con-
structing ithproVements to North Street and relocating a
sewer line:

The centerline.of both easements described as follows, to
wit: Starting at the Northeast Corner of the Northeast
Quarter of the Southwest Quarter of Section 9; thence North
890 44' West along the North line thereof a distance of
698.5 feet to a point on the existing Westerly Railroad
right of way line of the St. Louis and San Francisco Railroad;
thence in a Southwesterly direction on a curve left having a
radius of 3587.75 feet a distance of 30.0 feet to a point on
the existing Southerly right of way line of North Street;
thence continue in a Southerwesterly direction on a curve
left having a radius of 3587.75 feet a distance of 40.56
feet to a point on the proposed Southerly right of way line
of said North Street; thence North 89° 49' West along said
proposed right of way line a distance of 70.9 feet for a
point of beginning. Thence South 000 11' West along said
proposed right .of way line a distance of 27.0 feet to a
point; thence North 89° 49' West along said proposed right
of way line a distance of 29.7 feet to a point, which is the
centerline of Skull Creek.
STREET RIGHT-OF-WAY DESCRIPTION:
Part of the Northeast Quarter of the Southwest Quarter of
Section 9, Township 16 North, Range 30 West. Washington
County, Arkansas, more particularly described as follows:
Starting at the Northeast Corner of the Northeast Quarter of
the Southwest Quarter of Section 9; thence North 390 44'
West along the North line thereof a distance of 698.5 feet
to a point on the existing Westerly Railroad right of way
line of the St. Louis and San Francisco Railroad; thence in
a Southerwesterly direction on a curve left having a radius
of 3587.75 feet a distance of 30.0 feet to a point on the
existing Southerly right of way line of North Street for the
point of beginning; thence continue in a Southwesterly
direction on a curve left having a radius of 3587.75 feet a
distance of 40.56 feet to a point on the proposed Southerly
right of way line of said North Street; thence North 89° 49'
West along said proposed right of way line a distance of
63.9 feet to a point; thence South 000 11' West along said
proposed right of way line a distance of 12.0 feet to a
point; thence North 89* 49' West along said proposed right
of way line a distance of 29.7 feet to a point; thence North
14° 52' West a distance of 54.6 feet to a point on the
existing Southerly right of way line of said North Street;
thence South 89° 44' East along said existing right of way
line a distance of 108.0 feet to the point of beginning and
containing 0.10 acre, more or less.
