A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A MODIFICATION OF THE CITY'S FIXED BASE OPERATION LEASE AGREEMENT WITH SCHEDULED SKYWAYS, INC. d/b/a FAYETTEVILLE FLYING SERVICE TO AUTHORIZE USE OF THE OLD WOODEN HANDER AT DRAKE FIELD FOR AIRCRAFT MAINTENANCE. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the Mayor and City Clerk are hereby authorized and directed to execute a modification of the City's fixed base operation lease agreement with Scheduled Skyways, Inc. d/b/a Fayetteville Flying Service to authorize use of the old wooden hander at Drake Field for aircraft maintenance. A copy of the modification authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this //OP day othatte.it,,, 1982. a:4f Leo 1; ATTEST: . ,4 • c ! • APPROVED: MAYORe.") nouLx/Y . 4 mcC MODIFICATION OF LEASE AGREEMENT This agreement made this Yaaay of C)*(tA4114., 198CL, by and between the City of Fayetteville, Arkansas, a Municipal Corporation, hereinafter called Lessor, and Scheduled Skyways, Inc., an Arkansas business corporation, d/b/a Fayetteville Flying Service, hereinafter called Lessee. WHEREAS, the parties hereto have entered into a lease dated September 12, 1981, a copy of which is attached hereto, marked Exhibit "A" and made a part hereof; and WHEREAS, the parties desire to enter into a new agreement modifying or supplementing the provisions of said lease. NOW, 'THEREFORE, the parties mutually agree as follows: 1. Paragraph 2 of said Lease is modified by adding a second paragraph to read as follows: Lessor authorizes Lessee to use the old wooden hanger described in paragraph 1(b) above for general aviation maintenance. Lessee agrees to provide a general aviation mechanic at said wooden hanger during normal-Thusiness hours. Said mechanic.shall-be on .duty eight (8) hours per day, five (5) days (Monday through Friday) per week. Lessor authorizes Lessee to use the aforesaid wooden hanger to maintain aircraft owned by Scheduled Skyways, Inc., subject to the following conditions:' (a) Said maintenance shall not be conducted at any time the general aviation mechanic is on duty; and (b) Said maintenance shall not interfere in any way with customers of Lessee's fixed base operation and shall not result in a reduction in the type or quality of fixed base operator services lessee is required to perform under the terms of this lease. 2. All provisions of the lease are incorporated herein and are hereby modified or supplemented to conform herewith but in all other respects are to be and shall continue in full force.
