RESOLUTION NO. 1
A RESOLUTION EXPRESSING THE POSITION OF THE
FAYETTEVILLE BOARD OF DIRECTORS ON THE QUESTION
OF WHETHER THE WASHINGTON COUNTY QUOROM COURT
SHOULD ADOPT AN ORDINANCE PROVIDING FOR A REBATE
OF COUNTY SALES AND USE TAXES COLLECTED IN EXCESS
OF A SPECIFIED AMOUNT ON ANY SINGLE TRANSACTION.
' WHEREAS, the voters of Washington County approved a 1°J
county sales tax on July 28, 1981; and
WHEREAS,•'the ordinance approved by the electors did not
provide for a rebate of any county sales and use taxes
-rcollected in excess of a specified amount on any single

transaction; and •
WHEREAS, the voters of the City of Fayetteville approved
the county sales tax by a 2 to 1 margin; and
WHEREAS, certain Washington County merchants have.
petitioned the Quorom Court for the adoption of an ordinance
providing for a rebate of county sales and use taxes collected
in excess of a specified amount on any single transaction;
and
WHEREAS, said merchants claim that the county sales and
use tax has resulted in the reduction of their business
revenues and have suggested imposition of a $25.00 sales tax
"cap"; and
WHEREAS, the Washington County Quorum Court has requested
municipalities in the county to express their position
regarding the aforesaid proposed sales tax "cap".
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That while the Board of Directors is sympathetic
to Washington County merchants, and particularly Fayetteville
merchants, who perceive the county sales tax as reducing
their business revenues, it is the Board's position that it
would be inappropriate to attempt to solve the perceived
problem of proportionally few citizens of the county by
passing legislation affecting many citizens of the county.
Section 2. It is the position of the Board of Directors
that the imposition of a sales tax "cap" would be premature,
because precise revenue figures are not available to accurately

project sales tax revenues or the effect on county and
municipal financing such a "cap" would have.
Section 3. The City of Fayetteville therefore joins
its sister communities of Prairie Grove, Lincoln, Winslow,
West Fork; Tonitown, Farmington, and other municipalities in
opposing at this time the proposed $25.00 sales tax "cap".
Section 4. The Board of Directors recommends that
after the Quorom Court has determined the amount of county
., sales and use tax revenues actually received through September
1, 1982, the Quorom Court review the effect that imposition
of the proposed $25.00 "cap" would have on future sales and
use tax revenues.

Section 5. The Board of Directors recommends to the
Quorom Court that any ordinance providing for a rebate of
county sales and use taxes collected in excess of a specified
amount on a single transaction be referred to a vote of the
electors of Washington County.
