A RESOLUTION AUTHORIZING THE SALE OF 2.12 ACRES IN
THE FAYETTEVILLE INDUSTRIAL PARK TO NATIONAL BIOFUELS,
INC. AT A PRICE OF $6,500.00 PER ACRES. '
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorizes
the sale to National Biofuels, Inc. of 2.12 acres in the
Fayetteville industrial park at a sale price of $6,500.00
per acre. The legal description of the property authorized
for sale hereby is described in the Warranty Deed attached
hereto, marked Exhibit "A", and made a part hereof.
Section 2. That the Mayor and City Clerk are hereby
authorized and directed to execute the aforesaid Warranty
Deed.

WARRANTY DEED
KNOW ALL NEN BY THESE PRESENTS:
That the City of Fayetteville, Arkansas, a municipal
corporation, for an in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration to it in
hand paid by National Biofuels, Inc., does hereby grant,
bargain and sell unto the said National Biofuels, Inc. and
unto its assigns, the following described lands, situate in
Washington County, Arkansas, to -wit:
A part of Section 23 and a part of Section 26, Township
16 North, Range 30 West, Fayetteville, Washington
County, Arkansas, being more particularly described
as follows: Beginning at a point that is South 190.24
feet and East 1,871.00 feet from the NW corner of said
Section 26, said point being on the North right-of-way
line of Pump Station Road; thence leaving said right-
of-way N.1° 17' E 489.12 feet; thence N 76° 04' E 186.54
feet; thence S 1° 17' W 537.98 feet to the said North
right-of-way; thence N 88° 45' W 180.00 feet along said
North right-of-way to the point of beginning, containing
2.12 acres,more or less; subject to a 25 foot wide
utility easement adjacent to and parallel to the North
property line.
TO HAVE AND TO HOLD the said lands and appurtenances
thereunto belonging unto the said National Biofuels, Inc.,
and unto its assigns forever. And the said City of Fayetteville,
Arkansas, does hereby covenant that it is lawfully seized
of said land and premises; that sate is unencumbered, and
it will forever warrant and defend title to said lands against
all claims whatsoever.

BE IT REMEMBERED, that on this day came before the

aforesaid, duly commissioned and acting, Paul Noland and
Olivia Kelly, to me well known to be the Mayor and City
Clerk, respectively, of the City of Fayetteville, Arkansas,
a municipal corporation, Grantor in the foregoing Deed, and
stated that they had executed same on behalf of said Grantor
for the consideration and purposes therein mentioned and set
forth.
