A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AN AGREEMENT WITH LESTER LONGWITH FOR
THE OVERSIZING OF WATER LINES IN HAMSTRING CREEK
ADDITION.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized
to execute an agreement with Lester Longwith for the over -
sizing of water lines in Hamstring Creek Addition. A copy
of the contract authorized for execution hereby is attached
hereto, marked Exhibit "A", and made a part hereof.

OVERSIZING AGREEMENT
This agreement executed this / 971A day of odh,e6c ,
1982, by and between the City of Fayetteville, Arkansas, hereinafter called
the City and Mr. Lester Longwith, hereinafter called the Developer.
WHEREAS, the Developer is in the process of developing certain land
located within the City's extraterritorial planning jurisdiction; and
WHEREAS, in connection with said development, the Developer proposes
to install certain water lines; and,
•
WHEREAS, in order to accomodate expected future growth in the area,

the City desires that said utility lines be larger than the size proposed
by the Developer; and,
WHEREAS, the City is willing to pay the cost of "oversizing" said
utility lines.
NOW, THEREFORE, in consideration of the mutual covenants contained
herein, the City and the Developer agree as follows:
1. That the Developer shall install, or cause to be installed, water
lines in accordance with the plans and specifications attached hereto,
marked Exhibit A and made a part hereof.
2. Upon completion of construction, the Developer shall furnish the
City two sets of "As -Built" plans and lien waivers executed by all contract-
ors and subcontractors performing work or providing materials for the pro-
ject described in Exhibit A attached hereto, and the City shall immediately
pay the Developer a sum not to exceed $ 4, /26.50, provided said con-
struction is determined bythe City to be in accordance with plans and spec-
ifications and City Code requirements.
3. In connection with the project described in Exhibit A attached
hereto, the City shall have the following responsibilities:
a. Record all necessary easements after execution thereof
has been obtained by the Developer.
b. Review for approval as to form any proposed construction
contract between the Developer and an independent contractor.
c. Inspect construction of the utility lines for compliance
with contract specifications and City Code requirements.

d . Test all utility lines for compliance with contract
specifications and City Code requirements.
e . Pay the Developer the City's share of the project cost
as determined in section 4-c below.
4. In connection with the project described in Exhibit A attached
hereto, the Developer shall have the following responsibilities:
a. Prepare plans and specifications for the installation of water
and/or sewer lines.
b. Obtain execution of all necessary easements and provide said
executed easements to the City.
c. Secure "unit price" bids from at least two contractors ap-
proved by the City; said bids shall be based on the plans and specifica-
tions attached hereto and shall contain alternate bids with Alternate
Bid "A" to be for the size of line proposed by the Developer and Al-
ternate Bid "B" to be for the size of line desired by the City. The
difference between Alternates "A" and "B" shall be the City's share of
the project cost.
d . Enter into a construction contract with the low bidder of
Alternate Bid "B".
e. Pay the contractor for all work performed in accordance with
the terms of the construction contract.
IN WITNESS WHEREOF, the parties have executed this agreement on the
date first written above.

Water Main Oversizing Agreement
Don:
On October 7, 1982, bids were received for the construction of the water
main to serve the referenced addition. A tabulation of the bids is enclosed.
Also enclosed is an Oversizing Agreement with three copies.
Mr. Longwith has expressed his intention to accept the low bid of Combs
Construction if this is agreeable with the city and if the city will enter into
the oversizing agreement. If this is acceptable with the city, please proceed
as necessary to have the agreement completed.
If there are any questions, please advise. Your immediate attention to
this matter will be appreciated.

Attached is a Oversizing Agreement being proposed in connection
with the Hamestring Creek Addition. Also attached are the bids taken
on the project, a plat of the area, and the cover letter from Northwest
Engineers.
I am recommending oversizing the waterline to a 6 -inch from a
3 -inch which would serve the addition. The maximum cost to the City
would be $ 4,170.50.
The oversizing is needed to maintain adequate-:ltnesizein the
growth area.;
