A RESOLUTION AUTHORIZING THE •MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH SOUTHWESTERN ELECTRIC POWER COMPANY FOR AN UNDERGROUND ELECTRIC DISTRIBUTION SYSTEM TO SERVE THE CONTINUING EDUCATION CENTER. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the Mayor and City Clerk are hereby authorized and directed to execute an agreement with Southwestern Electric Power Company for underground electric distribution system to serve the Continuing Education Center. A copy of the agreement authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. 1981. PASSED AND APPROVED this1S4 day of 9710aj 0 ) APPROVED: • • MICROFILA •411 • SOUTHWESTERN ELECTRIC POWER COMPANY AGREEMENT FOR UNDERGROUND ELECTRIC DISTRIBUTION SYSTEM FOR COMMERCIAL AND/OR INDUSTRIAL CUSTOMERS BETWEEN Continuing Education Center (Customer - Developer) AND SOUTHWESTERN ELECTRIC POWER COMPANY It is mutually understood and agreed that: QA--) se,tat,ro ,61/JA-14/6- This agreement applies to installation and operation of an underground electric distribution system to serve commercial and/or industrial customers on an electric utility easement granted Southwestern Electric Power Company (SWEPCO) on East and Center Street in Fayetteville. Under this agreement customer will furnish: - - . A. Concrete pad for transformer in accordance with SWEPCO Standard. B . Concrete pads for any switching equipment required in loop system as outlinedin II C. C. Conduit from SWEPCO pole to transformer location. Conduit size will be 4" in case of three phase service and 2" for the single phase. This may be rigid galvanized, concrete encased duct, or Schedule 40 rigid plastic as required by local codes. For faster restoration of service in case of cable failure a spare conduit is recommended but not required except those cases where conduit is under a building. Customer elects to: ( ) 1. Install one conduit only. (X) 2. Install two conduits one being a spare. D . Service connection cables between transformer and service entrance equipment. Cables will be of sufficient length to be terminated on transformer bushings. (Connections will be made by SWEPCO.) E . Any necessary pullboxes or manholes occasioned by routing or by length. F. Pay the installed cost of primary cable in excess of 250 feet of conduit run. V. SWEPCO will furnish and install: A. All primary cable and necessary material for connection to overhead system. B . Transformers C. Switch enclosures D . Any overhead distribution required to provide this service. E . Termination of secondary cables. (continued on reverse side) • • 4 VI. Any rearrangements in the system which may be required by the customer after installation and any temporary work required by the customer shall be paid for by the customer. VII. Should customer, owner and/or developer abandon the use of this underground electric distribution system prior to fulfillment of contract period, he agrees to pay to the Company an amount of money equal to the depreciated value of the system installed, plus the removal cost, less credit for salvage material or equipment.
