A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A CONTRACT WITH HAILEY-POWERS-FRONING'LIMITED
AND McGOODWIN, WILLIAMS & YATES, INC., A JOINT VENTURE,
FOR PREPARATION OF NECESSARY ARCHITECTURAL AND ENGINEERING
PLANS TO SUBMIT A GRANT APPLICATION FOR FEDERAL FUNDS
TO CONSTRUCT A NEW SWIMMING POOL AT WILSON PARK.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized
and directed to execute a contract with Hailey-Powers-Froning
Limited and McGoodwin, Williams & Yates, Inc., a Joint Venture,
for preparation of necessary architectural and engineering
plans to submit a grant application for Federal funds to
construct a new swimming pool at Wilson Park; provided, the
total contract price shall not exceed $2,000.00.

CONTRACT
This contract executed this 3rd day of March, 1981,
between the City of Fayetteville, Arkansas, hereinafter
called "the City", and Hailey, Powers, Froning, Ltd., architects,
and McGoodwin, Williams, and Yates, Inc., engineers, operating
as a joint venture, hereinafter called."Architects/Engineers".
WHEREAS, the City proposes to construct a new swimming -
pool at Wilson Park, and
WHEREAS, the City proposes to submit a grant application
for federal funds to finance a portion of the cost of said
swimming pool; and
WHEREAS, said grant application must include architectural
and engineering plans for the proposed new swimming pool.
NOW, THEREFORE, the City and the Architects/Engineers
hereby mutually agree as follows:
1. The Architects/Engineers shall prepare those
architectural and engineering plans required for the City to
submit a grant application for federal funds to finance
construction of a new swimming pool at Wilson Park.
2. The Architects/Engineers shall provide all labor
and material required for the preparation of said plans.
Upon completion of said plans, the Architects/Engineers
shall provide the City 6 copies of said plans which
plans shall become the property of the City.
3. The City shall pay the Architects/Engineers a lump
sum of $2,000.00 for preparation of said plans. Said
consideration shall be payable in a lump sum upon completion
of said plans and delivery thereof to the City.
4. The contract documents which comprise the contract

between the City and the Architects/Engineers.consists of
this contract and the following documents attached hereto
and made a part hereof:
(a) Proposal by Architects/Engineers dated
February 22, 1981

5. The contract documents constitute the entire
agreement between the City and the Architects/Engineers and
may be modified only by a duly executed written instrument
signed by the City and the Architects/Engineers.
6. The Architects/Engineers shall not assign their
duties under the terms of this contract.
7. The Architects/Engineers shall at all times maintain
in full force and effect the following insurance:
(a) Workman's Compensation insurance as required
by Arkansas law;
(b) Public Liability Insurance with such company
and in such amounts as are approved by the City.
IN WITNESS WHEREOF, the parties have executed this
contract on the date first above written.

In response to your recent telephone call, we are enclosing three copies
of the contract providing for assistance in filing a grant application for
federal funds to help finance the new swimming pool complex at Wilson Park.
Attached to this document is the required letter of proposal from our firm.
The contract should now be ready for signature by city officials. We would
appreciate your returning two executed copies to our office.
We trust you will find this document in order and that you will soon be
in a position to process our statement of May 17th in the amount of $2,000.
Please let us know if you have any further question concerning this
matter.

In response to a request by the city through the Parks and Recreation
Advisory Board's Swimming Pool Committee, we are submitting herewith, on behalf
of Hailey-Powers-Froning, Architects, as well as our firm, a proposal for
preliminary studies and preparation of a grant application requesting federal
funds to assist in the construction of a new swimming pool at Wilson Park.
Our proposal is as follows.
Our firm, along with the architects, would conduct studies as required
to prepare a preliminary layout and preliminary cost estimate necessary for
completion and submission of a grant application to the Heritage Conservation
and Recreation Service of the Department of Interior for federal funds to aid
in financing construction of the proposed swimming pool facilities at Wilson
Park. Six copies of said documents would be provided to the city.
We propose to complete this work for a lump sum fee of $2,000.00, payment
to be due and payable upon completion of said work and delivery thereof to
the city.
We appreciate the opportunity to submit this proposal and hope that we
will be selected to serve the city on this project.
