A RESOLUTION RATIFYING THE ACTS OF JOHN TODD AS MAYOR
AND VIVIAN KOETTEL AS CITY CLERK IN -EXECUTING A WARRANTY
DEED ON BEHALF OF THE CITY OF FAYETTEVILLE, ARKANSAS,
CONVEYING 2.33 ACRES OF LAND IN THE FAYETTEVILLE IN,
DUSTRIAL PARK TO SOUTHWESTERN ELECTRIC POWER COMPANY.
BE TT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTE-
VILLE, ARKANSAS:
That the Board of Directors hereby ratifies the acts of John
Todd as Mayor and Vivian Koettel as City Clerk in executing on be-
half of the City of Fayetteville, Arkansas, the Warranty Deed dated
September 18, 1981 conveying 2.33 acres of land in Fayetteville
Industrial Park to Southwestern Electric Power Company which appears
of record in Deed Record Book 1050 at Pages 518 and 519 of the of-
ficial records of Washington County, Arkansas. A copy of said
Warranty Deed is attached hereto marked "Exhibit A" and made a
part hereof.

That the CITY OF FAYETTEVILLE, ARKANSAS, a alcigiPal
corporation, for and in consideration of the sum of One
Dollar ($1.00) and other good and valuable consideration to
it in hand paid by SOUTHWESTERN ELECTRIC POWER COMPANY, a
Delaware corporation, does herebygrant, bargain and sell
unto the said Southwestern Electric Power Company and unto
its successors and assigns, the following described lands,
situate in Washington County, Arkansas, to -wit:
A part of ,the Southwest Quarter (SW 1/4) of the Southwest
Quarter (SW 1/4) of Section Twenty-three (23), Township
Sixteen (16) North, Range Thirty (30) West, being also
a part of Lot Five (5) Fayetteville Industrial Park
Subdivision, Fayetteville, Washington County, Arkansas
and being more particularly described as follows, to -wit:
Beginning at a point which is North 00°52'51" East
507.05 feet from the Southwest corner of Section Twenty-
three (23), Township Sixteen (16) North, Range Thirty
(30) West, said point being an iron pin on the West line
of said Section Twenty-three (23); thence along said
section line North 00°52'51" East 391.37 feet to an iron
pin; thence leaving said section line South 84°19'
East 276.17 feet to an iron pin; thence South 05°41'
West 390.00 feet to an iron pin; thence North 84°19'
West 243.40 feet to the point of beginning and containing
2.33 acres more or less.
TO HAVE AND TO HOLD the said lands and appurtenances
thereunto belonging unto the said Southwestern Electric Power
Company, and unto its successors and assigns forever. And
the said City of Fayetteville, Arkansas, does hereby covenant
that it is lawfully seized of said land and premises; that
same is unencumbered, and it will forever warrant and defend
title to said lands against all claims whatsoever.
