A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A CONTRACT WITH J.K. TURNER & ASSOCIATES
FOR COMPUTER CONSULTANT SERVICES.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized
and directed to execute a contract with J.K. Turner & Associates
for computer consultant services. A copy of the contract
authorized for execution hereby is attached hereto marked
Exhibit
1981.

AGREEMENT
This Agreement executed this day of 10',1g
1981, between the City of Fayetteville, Arkansas, hereinafter
called the City, and J. K. Turner d/b/a J. K. Turner & Associates
hereinafter called the Consultant.
WHEREAS, the City desires to retain a computer consultant
to -review software problems of the fund management system,
utility billing system, and general operations of the City's
computer; and
WHEREAS, the Consultant has submitted a review proposal
which the City has found to be acceptable; and
WHEREAS, the purpose of this agreement is to set forth
the terms and conditions under which the Consultant will
review the software problems of the fund management system,
utility billing system, and general operations of the City's
computer system.
WOW, -THEREFORE, in consideration of the mutual covenants
contained herein, the City and the Consultant agree as follows:
1. The Consultant shall review the software problems
of the fund management system, utility billing system, and
general operations of the City's computer system and make
recommendations to alleviate said problems. Specifically,
the Consultant shall evaluate information flow, program operating
efficiency and program structure.
2. The City shall provide the Consultant with the following:
(a) Program description, documentation, run books,
and other data supplied by the program -developers;
(b) File layouts, report formats, and display formats;
(c) Number of accounts, approximate number of transac-,
tions per month, number of users (terminals), security
levels, and other management related information;
(d) A program demonstration with test data.
3. The services required of Consultant under this Agree
ment shall be performed by Dr. Abram L. Winters.

4. For services actually rendered by Dr. Abram L. Winters,
Consultant shall be paid at the rate of thirty-five dollars
($35.00) per hour: Consultant's estimated time for completing
the services required hereunder is -sixty-five (65) -hours.' The
City shall not be liable for payment for services rendered
in excess of sixty-five (65)biters, unless such additional services
are first authorized in writing by the City. .Consultant's
fee shall be payable in a lump sum upon submission to the
City of Consultant's written findings and recommendations.
5. Consultant shall render all services and submit
all written findings and recommendations required under this
Agreement by the Zpx- day of , 19 La.
6. Consultant shall secure and maintain such insurance
as will protect Consultant from claims under the Arkansas
Workman's Compensation Act and from claims for bodily injury,
death, or property damage which may arise from the performance
of Consultant's services under this Agreement..
7. Neither party shall assign or transfer his interest
in this Agreement without the prior written consent of the
other party.
8. This Agreement shall be binding upon the parties
hereto and upon their partners, successors, executors, admini-
strators and assigns.
9. The provisions hereof represent the entire agreement
between the parties. This Agreement may be altered, amended,
or rescinded only by a duly executed written agreement.
