A RESOLUTION EXPRESSING THE WILLINGNESS
OF THE CITY OF FAYETTEVILLE TO MATCH
FEDERAL HIGHWAY ADMINISTRATION
BICYCLE GRANT FUNDS
WHEREAS, the City of Fayetteville understands Federal Aid funds are
available for bikeway construction, and for nonconstruction projects that
can be expected to enhance the safety and use of bicycles; and
WHEREAS, the City has outlined its priority bike project to be an
educational and promotional program and the mapping and publishing of
bicycle routes with emphasis on commuter routes from residential areas
to business districts; and
WHEREAS, the City will be responsible for all costs above the amount
granted in Federal Aid funds (a minimum of 25% City funds);
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE, ARKANSAS, THAT:
SECTION I: The City of Fayetteville will participate in accordance
with its designated responsibility in this project.
SECTION II: The City of Fayetteville pledges its full support and
hereby authorizes and requests the Arkansas State Highway and Transpor-
tation Department to initiate action to implement this project.
SECTION III: The'Mayor is hereby authorized and directed to execute
all appropriate agreements and contracts necessary to expedite the imple-
mentation of the bicycle project in Fayetteville.
THIS RESOLUTION adopted this 16th day of Septe ber, 1980.

Re: FHWA Bicycle Grant Program
I am pleased to inform you that the City of Fayetteville has been selected to
receive a $15,000 Federal Highway Administration bikeway grant under Section
141(c) of the Surface Transportation Act of 1978. This award represents 75%
of the estimated project costs, as described in your grant application. Any
costs above.this grant award roust be borne by the city as additional Federal -
Aid funds are not available.
The grant funds must be obligated by the FHWA prior to September 30, 1980.
Prior to that date we must receive:
1. A council resolution committing funds and authorizing the. Mayor to
execute all necessary documents (enclosed).
2. A copy of the signed Memorandum of Understanding (enclosed).
3. A breakdown of the local match by source, including the source of
labor and materials for the in-kind match.
All of these documents need to be returned to Steve Mitchell, Planning and
Research Division, as near to September 19 as possible. If you have difficulty
in meeting this schedule, please contact Mr. Mitchell.

Products of the non -construction portion of the project and the selection of
designated routes must be submitted in draft form to Steve Mitchell, Planning
and Research Division. Final route selection and production of the maps,
bumperstickers and educational television series must first receive approval
in writing from the Arkansas Highway and Transportation Department.
Before the construction portion may be initiated, specifications for all pro-
posed materials and their exact planned placement must be submitted to Mr.
Mitchell by the City Engineer. In addition, the municipal financial officer
must meet with a representative of AHTD for a discussion of accounting proce-
dures, as well as an audit if part of the local match is to be by force account.
The project may be initiated only after receipt of written specification appro-
val from the Arkansas Highway and Transportation Department, completion of any
necessary audit and execution of a financial assistance contract which will be
forwarded later. Specifications should reflect the recommendations in Guide
for Bicycle Routes, prepared by the American Association of State Highway and
Transportation Officials.
Funds will be made available on a reimbursable basis after the completion of
each of three phases_: 1) map publication; 2) educational program; and 3) the
construction project. Inspection by AHTD and FHWA is necessary in addition to
the necessary documentation prior to reimbursement. Financial procedures will
be further clarified in a meeting to be scheduled between AHTD and your munici-
pal financial officer.

MEMORANDUM OF UNDERSTANDING
BETWEEN

WHEREAS, the Federal Highway Administration has awarded Federal -Aid funds
to (hereinafter referred to as the GRANTEE) in
accordance with Section 141(c) of the Surface Transportation Act of 1978; and,
WHEREAS, the governing body of the GRANTEE has passed a resolution authori-
zing the implementation of a bicycle project as described in the bicycle grant
application as approved by the Federal Highway Administration; and,
WHEREAS, the Arkansas Highway and Transportation Department (hereinafter
referred to as the DEPARTMENT) is directed by 23 CFR 663 to ensure that projects
are completed in a timely fashion and in substantial conformance with the details
outlined in the applicant's proposal;
NOW THEREFORE, it is mutually agreed that:
1. Specifications necessary to implement construction projects will
be approved by the DEPARTMENT in writing before construction begins.
2. Any changes in the agreed upon specifications deemed necessary by
the GRANTEE during construction be approved in writing by the DEPART-
MENT prior to substitution.
3. The GRANTEE will maintain facilities constructed under this program.
4. No motorized vehicles are to be permitted on any bikeway physically
separated from motorized vehicular traffic by an open space or
barrier, except those vehicles necessary for maintenance or enforce-
ment purposes.
5. A11 project educational materials which are to be published in accor-
dance with the project description. as approved by the Federal Highway
Administration shall not be published until a draft has been reviewed
and approved in writing by the DEPARTMENT.
6. All published materials shall contain the acknowledgement, "Prepared
in cooperation with the U.S. Department of Transportation, Federal
Highway Administration."
7. All actions under the terms of this agreement will be in compliance
with the applicable requirements of Title 49, Code of Federal Regu-
lations, Part 21, which was promulgated to effectuate Title VI of
the Civil Rights Act of 1964.
g, The GRANTEE shall be required to save harmless the DEPARTMENT from
any and all claims, demands, suits and judgements of sums of money
to any party for loss of life or injury or damage to persons or pro-
perty growing out of, resulting from or by reason of any negligent .
act or omission, operation ot` work of the GRANTEE, its agents, ser-
vants or employees while engaged in or in connection with:actions
required or performed by the GRANTEE hereunder.
9. Fiscal procedures outlined by the DEPARTMENT will be utilized by the
GRANTEE in the documentation and disbursement of all project funds,
and all city records relevant to the project will be available for
audit at reasonable times by the DEPARTMENT and the Federal Highway
Administration.
10. Right of way required for construction of any bikeway physically
separated from motorized vehicular traffic will be provided at no cost
to the project and that proof of acquisition be supplied to the DEPART-
MENT.
11 Reimbursement for 75% of monies spent on the approved project up to the
grant amount will be made after inspection by the DEPARTMENT and the
Federal Highway Administration. Inspections may be requested after
each phase as described in the' grant award letter: -
12. The GRANTEE will take all reasonable steps in accordance with 49 CFR 23
to insure that minority business enterprises have the maximum opportunity

WITNESSETH: that
WHEREAS, Section 141(c) of the Surface Transportation Assistance Act of 1978
authorizes the apportionment of funds for construction of bikeway projects, non -
construction projects or a combination to promote the use of bicycles for trans-
portation and enhance access, mobility or safety for bicyclists, and provides
further that funds be made available through the State to the City approved by
the Federal Highway Administration (FHWA); and
WHEREAS, the Department has been directed under the authority of 23 CFR 663 to

administer the Bicycle Grant Program within the State of Arkansas; and
WHEREAS, the City has been approved by FHWA as the recipient agency of funds for
implementing a bicycle project; and

NOW THEREFORE, for and inconsideration of the mutual covenants herein contained,
the parties hereto agree as follows:
Section 1. Purpose of Contract. The purpose of this Contract is to promote
the use and safety of bicycles for the general public in the City of Fayette-
ville and to state the terms, conditions and mutual understandings of the
parties as to the manner in which the Project will be undertaken and completed.
Section 2. Scope of Project. The City will undertake and complete the Pro-
ject as specified in Exhibit A, which is hereinafter attached and made an integral
part of this contract.
Section 3. Period of Performance. The City will commence, carry on, and
complete the Project with all practicable dispatch, in a sound, economical and
efficient manner by the end of the contract period to commence the 29 day of
October , 1980 and end the 31st day of March , 1982.

Section 4. Statement of Financial Assistance. This contract is subject
to a financial assistance contract between the Department, the State and the
Federal Highway Administration.
Section 5. Cost of Project. The cost of the Project will not exceed
$ 15,000.00' , Federal participation. Compensation for services performed
under this contract will be based on actual cost incurred by the City with a

Federal share maximum of seventy-five percent (75%). Compensation shall be based
on actual auditable costs incurred under this contract. Costs shall not exceed
those eligible costs set forth by State law and by Federal Management Circular
74-4.,
The City shall initiate and complete all actions necessary to provide its
share of the Project costs at, or prior to, the time that such funds are needed
to meet Project costs.
The .City further agrees that local matching funds shall not be reduced below.
one-third (1/3) of the Federal participation unless changes, which would
proportionately reduce the scope of the Project, are approved by the Department.
The Department will make payments based upon.properly prepared statements
and a billing from the City summarizing all authorized and allowable costs by
classification of costs showing description, quantities, price, extension and
total. All costs must be reasonable and identifiable. Such payments will be
made after the completion and inspection of each project phase as identified in
Exhibit A. Inspection will be made by representatives of the FHWA and the
Department. The City shall submit a final billing within ninety (90) days of
the close of the Project. Prior to final payment, an audit of the records sup-
porting the costs claimed by the City shall be made in accordance with generally
accepted audit procedures. The City shall bear the responsibility for all funds
determined to be ineligible for Federal reimbursement and shall refund to the State
any reimbursement already received.

Section 6. Proper Use. Project facilities and products shall be used for
the promotion of bicycle use and safety as described in Exhibit A for the duration
of their useful life. The City shall immediately notify the Department in all
cases where Project facilities are used in a manner substantially different from
the description in Exhibit A, or where Project facilities are withdrawn from
public use.
Section 7. Motorized Vehicles Prohibited. No bikeway constructed with funds
from this grant may be authorized for motorized vehicular use when the bikeway is
physically separated from on -street vehicular traffic by an open space or barrier.
Only those vehicles necessary for maintenance or enforcement purposes will be
allowed.

Section 8. Maintenance. The City will adequately maintain facilities con-
structed,under this program. Facilities shall be subject to FHWA inspection to
insure maintenance during the useful life of the Project.
Section 9. Records and Reports. The City shall advise the Department
regarding progress of the Project by submission of reports in such manner as the
Department or FHWA may require.
All records relating to the Projectshall be maintained by the City for
three (3) years after final payment from the Department. The City shall retain
and make available to the Department financial statements, data, records, con-
tracts, and other documents related to the Project as may be deemed necessary by
the Department.
The Department and FHWA shall be accorded proper facilities for review and
inspection of the work provided herein and shall at all reasonable times have
access to the premises and to all books, records, correspondence, instructions,
receipts, vouchers and memoranda of every descriptionpertaining to the Project.

Section 10. Audit and Inspection. The City shall permit the Department, the
Comptroller General of the United States and the Secretary of the United States
Department of Transportation or their authorized representatives, to inspect all
facilities and materials purchased by the City as part of the Project; and all
relevant Project data records. The City shall also permitthe above named persons
or their authorized representatives to audit the books, records, and accounts of
the City pertaining to the Project.
_Section 11. .Third -Party Contracts. Unless otherwise authorized in writing
by the Depa Itment; the City shall not assign any portion of the work to be per-
formed under this Contract, or execute any contract, amendment or change order
thereto, or obligate itself in any manner with any third party with respect to
its rights and responsibilities under this Contract without the prior written con-
currence of the Department.
Section 12.. Specification Approval. No construction shall be started
until written approval of specifications for materials and their placement is
received from the Department.
Section 13. Education Material Review. All Project materials are to be
prepared in accordance with the Project description appearing in Exhibit A.
Final production and release may not be made until a draft has been reviewed and
approved in writing by the Department.
Section 14. Ownership of Data. All materials published by the City as a
result of the Project shall contain an acknowledgement as follows:
"Prepared in cooperation with the U.S. Department of
Transportation, Federal Highway Administration, and
the Arkansas State Highway and Transportation Depart-
ment."

"The contents of this report reflect the view of the City
who is responsible for the facts and the accuracy of the
data presented herein. The contents do not necessarily
reflect official views or policies of the Arkansas State
Highway and Transportation Department, or the Federal
Highway Administration."
The City is free to copyright material developed under this Project with.
the provision that the Department and the U.S. Department of Transportation
reserve a royalty -free, non-exclusive and irrevocable license to reproduce,
publish, or otherwise use, and to authorize others to use, the work for Govern-
ment purposes.
I. Section 15: Contract Changes. Occasionally, during the course of the Pro-
ject, it may become necessary to affect certain changes and/or modifications in
the original proposal. All such changes in budget, time, personnel, objective
and scope shall be justified in writing by the City and forwarded to the Depart-
ment for written approval prior to any change being made. Any changes necessitated
by the Department will be negotiated with the City.
Section 16. Arbitration. Any dispute concerning a question of fact in
connection with the work not disposed of by contract between the parties hereto
shall be referred to the Assistant Chief Engineer for Planning and Development of
the Department or his duly authorized representative for determination, whose
decision in the matter shall be final and conclusive on the parties to this con-
tract.
Section 17. Termination.
(a) For Cause. The Department may, by written notice to the City, terminate
the Project and cancel this agreement for any of the following reasons:
(1) The City takes any action pertaining to this Contract without

the approval of the Department and which, under the procedures of
this Contract, would have required the approval of the Department;
(2) The Commencement, execution or timelycompletion of the Pro-
ject by the City is, for any reason, rendered improbable, impossible
or illegal.

(3) The City shall be in default under any provision of this Contract.
(b) Mutual Agreement. By mutual agreement and consent of the parties
thereto, this contract may be terminated.
Section 18. Governing, Rules and Regulations. The City and its subcontractors

will ;comply with all Federal, State and local laws, statutes, ordinances, rules
and regulations, and the orders and decrees of any court or administrative bodies
or tribunalsin any nature affecting the performance of this Contract, including
without limitation workmen's compensation laws, minimum and maximum salary and
wage statutes and regulations. When required, the City shall furnish the State
with satisfactory proof of its compliance therewith.
Section 19. Covenant Against Contingent Fees. The City warrants that it
has not employed or retained any company or person, other than a bona fide em-
ployee working solely for the City to solicit or secure this contract, and that
it has not paid or agreed to pay any company or person, other than a bona fide
employee working solely for the City any fee, commission, percentage, brokerage
fee, gifts, or any other consideration, contingent upon or resulting from the
award or making of this Contract. For breach or violation of this warranty the
Department shall have the right to annul this Contract without liability, or at
its discretion, to deduct from the contract price or consideration, or otherwise
recover, the full amount of such fee, commission, percentage, brokerage fee, gift,
or contingent fee.

Section 20. Interest of Members of, or Delegates to Congress. No member
of, or delegate to, the Congress of the United States shall be admitted to any
share or part of this contract or to any benefit arising therefrom.
Section 21. Prohibited Interest. No member, officer, or employee of the
City during his tenure or one year thereafter shall have any interest, direct
or indirect, in this Contract or the proceeds thereof..
Section 22: Equal Employment Opportunity. In connection with the execution
of this Contract, the City shall not

Such actions shall include, but not be limited to, the following: employment;
upgrading; demotion or transfer; recruitment or advertising; layoff or termination;
rates of pay or other forms of compensation; and selection for training, including
apprenticeship.
Section 23. Title VI - Civil Rights Act of 1964. The City will comply with
all the requirements imposed by Title VI of the Civil Rights Act of 1964 (78 Stat.
252), the Regulations of DOT issued thereunder (CFR Title 49, Subtitle A, Part 21),
and the assurance by the City pursuant thereto.
Section 24. Minority Business Enterprise (MBE). It is the policy of the
Department of Transportation that minority business enterprises as defined in.
49 CFR Part 23 shall have the maximum opportunity to participate in the perfor

mance of contracts financed in whole or in part with Federal funds under this
agreement. Consequently the MBE requirements of 49 CFR Part 23 apply to this
agreement. The City and any subcontractor agree to ensure that minority business
enterprises as defined in 49 CFR Part 23 have the maximum opportunity to partici-
pate in the performance of contracts and subcontracts financed in whole or in
part with Federal funds provided under this agreement. In this regard the City

and any subcontractor shall take all necessary and reasonable steps in accordance
with 49 CFR Part 23 to ensure that minority business enterprises have the maximum
opportunity to compete for and perform contracts. The City and its subcontractors
shall not discriminate on the basis of race, color, national origin, or sex in
the award arid performance of DOT -assisted contracts.
If as a condition of assistance the City has submitted and the Department
has approved a minority business enterprise affirmative action program which the
City agrees :to carry out, this program is incorporated into this financial assis-
tance agreement by reference. This program shall be treated as a legal obligation
and failure to carrylout its terms shall be treated as a violation of this finan-
cial assistance agreement. Upon notification to the City of its failure to carry
out the approved program the Department shall impose such sanctions as noted in
49 CFR Part 23, Subpart E, which sanctions may include termination of the agree-
ment of other measures that may affect the ability of the City to obtain future
DOT financial assistance.
The City shall advise each subrecipient, contractor, or subcontractor that
failure to carry out the requirements set forth in 23.43(a) shall constitute a
breach of contract and, after the notification of the Department, may result in.
termination of the agreement or contract by the City or such remedy as the City
deems appropriate.
Section 25. Third -Party Contract Warranties. The City shall include the
appropriate aboverequired clauses in all subcontracts entered into pursuant to
this Contract. In addition, the required provision in Section 4 shall be included
in any advertisement or invitation to bid for any procurement underthis`contract.
Section 26. Hold Harmless Clause. The City shall save harmless. the Depart-
ment and the U.S. Department of Transportation from all claims and liability due
to its negligent acts or omissions or the negligent acts or omissions of its sub-
contractors, agents or employees.

Section 27. Procurement and Project Management. The City shall use its
own procurement procedures which reflect applicable State and local laws and
regulations, provided the procedures conform to the standards set forth in
Section IV A of the Federal Highway Administration's Guidelines for Grantees'
Financial Management Systems. Applicable fiscal procedures set forth in the
above document shall apply to project management unless the City is otherwise
directed by the Department and/or the Federal Highway Administration.
Section 28:: Contract Defaultfailure to meet any contract conditions
`shall be sufficient cause for FHWA to require reimbursement of any of all Federal
funds'previously:paid to the City.

FAYETTEVILLE FHWA BICYCLE GRANT PROJECT
NON -CONSTRUCTION PORTION
Bike Route Map Publication
The map will serve two purposes: First, it will show bicyclists the most
suitable routes for commuter, neighborhood, and recreational riding. All too
often, a beginning bicyclist attempts to ride on roadways. he found best for
getting around by automobile. These streets are frequently some of the worst

for bicycling. .The map will help solve this problem by showing alternate routes
with less traffic, fewer hills, and greater line of sight.
Secondly, the map will be utilized for dispersing information pertinent to
bicycling such as Bicycle Rights and Rules (a listing of state and local laws
pertaining to bicyclists), Safety Tips (for example: slow down and cross rail-
road tracks at right angles), Care of the Bicycle (for example: keep tires pro-
perly inflated), Parking Information (where racks are located and proper locking
techniques), and availability of bicycle safety programs in the city. (A listing
of different programs available in public schools, on Fayetteville local tele-
vision, through bike clubs, and other organizations.)
The routes outlined on the map will be selected by the Fayetteville Bicycle
Committee, with public hearings held to determine the desirability of the routes
selected, before final approval by the City Board of Directors. The Bicycle
Committee will then administer both .the design and printing of the map. The
map will be 11" X 17" and printed on both sides.. Upon completion, it will be
available for free distribution to the public. About 5,000 maps. will be printed
initially.

Films
In order to enhance existing safety programs and provide a medium for use
by community organizations, the Fayetteville Bicycle Committee will preview and
select motion picture films to be purchased and housed by the Roberta Fulbright
Public Library. Films directed at both adults and children will be selected.
-Films could be checked out for showing at civic club meetings, bicycle and other
Vub meetings, to employees of businesses, or the films could be used to enhance
existing safety programs in schools or rodeos offered by police or any other
community organization. The films will also be made available for airing on
local television. .�
Educational Program for Local Television
The Bicycle Education program will be based on the Effective Cycling course
developed by John Forester. The techniques and safety measures taught in the
course are considered to be the state of the art. The program will consist of
approximately ten one hour segments on the Fayetteville open channel. The admini-
stration of the local television programming will be handled by the Bicycle
Committee.
Effective Cycling teaches the craft of cycling - the basic ability to con-
sistently use.a bicycle with confidence and competence for whatever pleasure,
utility, or sporting purpose ?asired under a-11 conditions of climate, terrain,
highway and traffic.
The student is expected to become capable of daily commuting to work or to
school, riding on day trips alone or with an organized club; or joining an
organized overnight tour; and would be well prepared for Joining a cycling club.
A textbook will be available at moderate cost for supplemental reading to
those who desire it.
The course covers four areas:
1) The Bicycle: Choosing a bicycle suitable for your needs and :performing

all maintenance necessary to keep it operating over its normal life. This requires
learning all the mechanical principles of bicycles and acquiring familiarity with
using the normal bicycle tools in adjustment and repair operations.
2) The Cyclist: Learning the proper posture and pedaling techniques, and
cycling sufficiently. to develop the motor skills for smooth supple action. Learn-
ing the theory of physical conditioningfor an endurance sport, including muscle
strength, oxygen transport, and metabolic fuel production; and cycling sufficiently
`to develop strength and circulatory capacity and short-term endurance for a 2.5
hour ride atmoderate speed. Learning the theory of bike handling and developing
the reflexes for instant emergency turns and stops.
3) The Cycling Environment and Traffic Safety: Learning the basic types of
car/bike collisions and the principles of the traffic rules that prevent them;
the basic types of highway design and the techniques of obeying the traffic rules
on a bicycle for each design; the basic types of roadway surface hazards and the
proper emergency traffic maneuvers for all types of highway and in all conditions
of traffic. Learning, with practice if climate permits, the special techniques
for wet weather and nighttime.
4) Cycling Enjoyment: Learning the basic technique of utility and commuting
cycling; learning and practicing the technique of individual racing (time trial-
ing) over short (6 to 10 mile) distances; learning and practicing the technique
of organized group cycling; learning enough about cycling clubs and cycle touring
to be prepared to join a club or an organized tour.
Bumperstickers
To promote the use of bicycles, bumperstickers will be designed and manu-
factured under the administration of the Fayetteville Bicycle Committee (for
example: a sticker could read, "I'd rather be riding by bicycle"). The bumper -
stickers will be distributed free to the public promoting awareness of the bike-
way program in the transportation flow.

Public Service Announcements
Public service announcements will be requested on radio, television, and
in Newspapers. Funds will be used to purchase spots on television and radio
to_air_PSA'_s.available from the Department of Transportation and other public
agencies. Airing of PSA's will be at selected times to coordinate with the imple-
-mentation of other programs under this proposal, i.e. air PSA's in conjunction with
distribution of the maps Time spots will be selected which will address the
target audience of bicyclists and potential bicyclists. Also, PSA's will be
used to announce and advertise the educationalprogram developed. Information
geared both to bicyclists and motorists will be included in different announce-
ments, promoting the safe use of bicycles. Information similar to that included
in the map could be used as well as announcing the availability of the maps and •
bumperstickers. The information will be distributed by the Bicycle Committee.
CONSTRUCTION PORTION
Signing of Routes
Public meetings will be held to designate approximately ten miles of
Fayetteville streets as signed Class III bike routes. Emphasis will be placed
on routes which will connect residential areas with the downtown area, the
university, and community parks, such as Wilson and Walker °arks. Signs will
include the Uniform National Bike Route Sign, directional arrows, and hazard
signs. -
Bicycle Racks
Parking facilities will be provided at the library, community parks,
neighborhood parks, the youth center, and city hall. Criteria will be placed
on movable racks, but security will not be compromised. A set of racks adapta-
ble to transit buses will be purchased to be placed on one bus on an experimen-
tal basis. Exact numbers and placement of all bicycle racks will be determined
at public meetings in conjunction with the bike route designation.
