RESOLUTION NO. 77-20
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AN AGREEMENT WITH McCLELLAND CONSULTING
ENGINEERS, INC. FOR PREPARATION OF A TEN YEAR MASTER
PLAN FOR THE FAYETTEVILLE MUNICIPAL AIRPORT.
BE IT RESOLVED- BY. THE_. "BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized
and directed to execute an agreement with McClelland Consulting
Engineers, Inc. for preparation of a ten (10) year master
plan for the Fayetteville Municipal Airport. A copy of the
agreement authorized for execution hereby is attached
hereto marked Exhibit "A" and made a part hereof.

AGREEMENT FOR ENGINEERING SERVICES
THIS AGREEMENT, made this ifday of
1980, by and between CITY OF FAYETTEVILLE, ARKANSAS,
hereinafter
referred to as the OWNER, and McCLELLAND CONSULTING ENGINEERS,
INC., Fayetteville, Arkansas, hereinafter referred to as the
ENGINEER:
The OWNER desires to prepare a Ten-year Development Plan for
the Fayetteville Municipal Airport, known as Drake Field, situated
in the City of Fayetteville, Washington County, State of Arkansas,
and the ENGINEER agrees to perform the professional engineering
services required for same.
WITNESSETH:
That for and in consideration of the mutual covenants and agree-
ments between the parties hereto, it is hereby agreed:
SECTION A - ENGINEERING SERVICES
That the ENGINEER shall furnish basic engineering services as
follows:
1 Preparing and submitting a planning grant' application
to the Federal Aviation Administration.
2 Arranging and coordinating meetings with the Federal
Aviation Administration to facilitate execution, review
and approval of the work.

3. Providing aerial/topographic mapping of the
immediate planning area, to include:
A. An aerial photo,
at a scale of 1"
for distortion;
B. An aerial photo,
at a scale of 1"
for distortion;
C. A photogrammetric mylar of the vicinity
topography, measuring 60" x 36", at a
scale of 1" = 200', with 5' contour
intervals, corrected for distortion;
and
D. A photogrammetric mylar of the vicinity
topography measuring 30" x 20", at a scale

4 Collecting, analyzing,

and mapping all known existing
structures, etc., in the
immediate planning area and superimposing the infor-
mation on the drawings described under item No. 3,
heretofore.
5. Collecting, analyzing, and making recommendations
concerning the proposed development plan's relation-
ship to existing: area land use planning efforts;
historical preservation considerations; laws; and
ordinances.
6. Forecasting future air traffic criteria for
Drake Field regarding based aircraft, aircraft mix,
projected aircraft operations, passenger enplanements,
air cargo, and airport accessibility.
7. Analyzing, based upon the forecasts derived under
item No. 6, the relative costs and benefits of
constructing new/improving existing:
A. Access roads;
B. Utility services;
C. Hangars, tie -downs, and aircraft
parking spaces;
D. Office spaces;
E. Commercial shops;
F. Taxiways;
G. Parking facilities for employees, visitors,
patrons, and rental cars;
H. General airfield and NAVAID facilities,
to include radar and microwave landing
systems;
I. Airport terminal facilities.

8. Summarizing the facility requirements based upon
the analyses performed under item No. 7, discussed
heretofore, to include a more detailed analysis of
those items which appear to be most cost effective.
In addition to those items generally mentioned in
item No. 7, specific attention will be given to:
A. Runway extensions, including the feasibility
of a cross -wind runway for light aircraft;
B. Safety appurtenances;
C. Drainage;
D. Lighting and marking;
E. Expanded maintenance facilities; and
F. Land acquisition
9. Assessing the environmental impacts of the cost
effective improvements, primarily from the
standpoint of noise and air pollution, displace-
ment of people, disruption of existing land uses,
effect on recreational areas, and interference
with wildlife or endangered species.
10. Development of a land use plan for airport property,
giving special attention to areas set aside for the
terminal complex, maintenance facilities, commercial
buildings, airport access, buffer zones, and
recreational sites.

11. Based upon the foregoing,preparation of
airport layout plan drawing to illustrate
the proposed approach and clear zone areas,
runway configuration, taxiways, aprons,
terminal building, general aviation facilities,
hangars, parking, and maintenance buildings.
This airport layout plan is to be provided to
the Airport Committee/City of Fayetteville for
review prior to development of the final plan.
12. Recommendations for a land use plan for
non -airport property which is in close proximity
to airport property and may be affected by
obstruction clearance and noise exposure criteria.
13. Preparation of a plan to achieve adequate access
for land vehicles to proposed airport facilities,
giving special attention to the probable need of
initiating access to the eastern side of the
improvement area.
14. 'Categorization of the indicated improvements into
short, intermediate, and long-range goals,to facilitate
"phased development" of the proposed facilities, to
include charts which show the proposed schedule of
development relating to the projected aeronautical
demands.

15. Formulation of construction cost estimates for
all proposed developments associated with the
10 -year Plan, said estimates being related to
the proposed schedule of development and based
upon forecasted construction costs.
16. Formulation of a plan for financing the imple-
mentation of the Ten -Year Development Plan, to
include as a minimum the practicality of increased
taxes, general obligation bonds, revenue bonds,
private financing, governmental assistance, or a
combination of all of these funding avenues.
17. Submittal of bi-monthly progress reports to the
Airport Committee/City of Fayetteville summarizing
interim period tasks accomplished and projected
activities related to the project.
18. Preparation and presentation of an Interim Report
to the Airport Committee/City of Fayetteville, to
include a preliminary airport lay -out plan (showing
proposed land use, terminal areas, and access
requirements) and rough cost estimates.
19. Preparation and presentation of the final Ten -Year
Development Plan, incorporating all elements of the
work .set .forth heretofore in item Nos. 1 through 18,
including consideration of comments resulting from
presentation of the Interim Report.

20. Assisting the Airport Committee/City of Fayetteville,
as requested, in coordinating and conducting a
Public Hearing to present the findings of the Ten -Year
Development Plan to the local citizenry.
21. Evaluation of comments received at the Public Hearing,
described in item No. 21, and incorporation of pertinent
!'feed -back" into the final report.
SECTION B - COMPENSATION FOR ENGINEERING SERVICES
That the OWNER shall compensate the ENGINEER for engineering
services based upon the following schedule:
DEVELOPMENT PLANNING: For all services described in Section
A, Paragraphs 1 through 21, the sum of Fifty-four thousand, three
hundred eighty-eight dollars ($54,388.00).
SECTION C - ADDITIONAL ENGINEERING SERVICES
The OWNER may wish to increase the engineering services
herein to include those needed for additional planning,
additional surveys, legal descriptions, or any services not
specifically included in the scope of this contract. In such
event, it is mutually agreed that compensation for such services
shall be determined by the following hourly schedule:

SECTION D - TIME FOR COMPLETION
The ENGINEER will commence work on the Ten -Year Development
Plan upon official, written notification by the OWNER
complete the final plan for the OWNER'S
endar year from the notice to

proceed. Unforeseen delays or
changes in the scope of work, as heretofore set forth, shall
be considered just cause for a request for a reasonable time
extension.
SECTION E - TERMINATION
In the event the ENGINEER, due to causes beyond his control
shall become unable to complete the contract provisions herein,
the OWNER, after receipt of written notification from the ENGINEER,
may void the contract and employ another engineer to complete the
work. In such event, all notes, calculations, drawings, spec-
ifications and all other data developed and accumulated by the
ENGINEER pertaining to the work hereunder shall be released to
the OWNER for the OWNER'S disposition. Compensation due the ENGINEER
will be determined by unit prices established in Section C, hereunder.
In the event the ENGINEER shall breach the contract here-
under, shall fail to perform the delineated tasks hereunder, or
shall not perform the contract in a manner suitable to the OWNER,
the OWNER may terminate this contract by written notice, effective
at the time of receipt of notice by the ENGINEER. In such event,
all notes, calculations, drawings, specifications and all other
data developed and accumulated by the ENGINEER pertaining to the
work hereunder shall be released to the OWNER for the OWNER'S
disposition. Compensation due to the ENGINEER under any one of
the circumstances stated will be determined by the unit prices
e stablished in Section C, hereunder, with the added provision
that such compensation shall not exceed the arithmetic difference
between the contract price hereunder and the total monies actually
t o be paid another engineer who has been employed to complete the
work.
It is expressly agreed that the basis for this contract lies
in the mutual confidence existing between the OWNER and the ENGINEER.
Therefore, it is the intent that this contract shall be continued
and consummated by the parties hereto. The termination paragraphs
h erein are provided in the unlikely event such described conditions
should occur.
SECTION F - ACCESS TO RECORDS
It is further agreed that the OWNER, the Federal Aviation
Administration, the Comptroller General of the United States,

or any of their duly authorized representatives, shall have
access to any books, documents, papers and records of the
ENGINEER which are directly pertinent to the work hereunder,
for the purpose of making audit, examination, excerpts and/or
transcriptions.
SECTION G - ACKNOWLEDGEMENTS
In executing this contract the ENGINEER acknowledges that
he has visited the site of the work, that he is familiar with
conditions and characteristics of the site, and that he fully
understands the nature, extent and character of the project and
the time limitations placed thereupon. He further states that
he has discussed the proposed work with the representative of the
OWNER.
The ENGINEER hereby states that he has and will comply with
the requirements specified in Title IV of the Civil Rights Act
of 1964 and in CFR Part 7.
The ENGINEER hereby states that he has performed planning
and design engineering on previous airport projects, as well as
other projects of a similar nature; that through his laboratory
facilities, he has previously performed pertinent work on other
airport projects, as well as other projects of a similar nature;
and that he has the staff and capabilities to perform the work
described herein, in a professional and timely manner.

CERTIFICATION OF ENGINEER
I hereby certify that I am the President and duly authorized
representative of the firm of McClelland Consulting Engineers,
Inc., whose address is 1810 North College Avenue, Fayetteville,
Arkansas, and that neither I nor the above firm I hereby.
represent has:
a. employed or retained for a commission, percentage,
brokerage, contingent fee, or other consideration,
any firm or person (other than a bona fide employee
working solely for me or the above consultant) to
solicit or secure this contract,
b agreed, as an express or implied condition for obtaining
this contract, to employ or retain the services of any
firm or person in connection with carrying out the
contract, or
c. paid or agreed to pay to any firm, organization, or
person (other than a bona fide employee working solely
for me or the above consultant) any fee, contribution,
donation, or consideration of any kind for, or in
connection with, procuring or carrying out the contract.

of Transportation, in connection with this contract involving
participation of Airport Development Aid Program (ADAP) funds
and is subject to applicable state and federal laws, both criminal
