A RESOLUTION AUTHORIZING THE SALE OF LOT 16, TRACT B,
IN THE FAYETTEVILLE INDUSTRIAL PARK, TO AMERICAN BIOFUELS,
INC.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorizes
the sale of Lot 16, Tract B, in the Fayetteville Industrial
Park to American Biofuels, Inc., at a price of $14,250.00
Section 2. That the Mayor and City Clerk are hereby
authorized and directed to execute all necessary documents
to close the sale of the aforesaid property.

the sentence "The City shall retain control of the parking lot adjacent to the
old Terminal Building and may permit employees in the old Terminal Building,
the FAA Building, and the hanger areas to park in said lot."
46.1 Director Noland, seconded by Lancaster, moved to approve the contract as
amended including any other provisions recommended by the Purchasing Officer,
City Manager, and City Attorney. The recorded vote was:
Ayes: Lancaster, Noland, Osborne, Sharp, Todd, Henry
Nays: None
Absent at Roll Call: Colwell.
The mayor declared the motion passed.

I -PARK SALE
46.2anager Grimes and City Engineer Bunn recommended the sale of property
in the Fayetteville Industrial Park to American Biofuels; Inc. for a 2.17 -acre
tract just east of the Amtane site on Pump Station Road. The sale price is $14,250,
which includes a $2,400 pro -rata share of the sewer line already installed and
$2,050 set-aside for the pro -rata share of paving Pump Station Road.
;46.3 Director Osborne made a motion to approve the sale. Mayor Todd seconded the
motion and the recorded vote was:
Ayes: Lancaster, Noland, Osborne, Sharp, Todd, Henry
Nays: None
Absent at Roll Call: Colwell

PARKING TOW -AWAY ZONES
;46.4 The City Attorney read an ordinance authorizing the impoundment of vehicles
which remain parked in any parking space for a longer time than designated for the
particular space.
46.5 Director Osborne asked how this would be designated and Grimes said signs
would indicate the time limit and indicate a tow -away zone.
;46.6 Following discussion, Director Osborne moved to table this so that Grimes
and McCord can address the question' of allowing cars to stay on city streets for
for 48 hours as provided in the Code Book. Director Henry seconded the motion and
the recorded vote was:
Ayes: Lancaster, Noland, Osborne, Sharp, Todd, Colwell, Henry
Nays: None
The Mayor declared the motion passed.
EASEMENT REDUCTION/VILLA NORTH SUBDIVISION
146.7 The City Attorney read an ordinance reducing a utility easement in Villa North
Subdivision, from 10 feet to 7.5 feet, and indicated that this ordinance has the
approval of all utility companies and the city engineer.
;46.8 Director Oshorne, seconded by Todd, moved the rules be suspended and the
ordinance be placed on second reading. The recorded vote was:
Ayes: Lancaster, Noland, Osborne, Sharp, Todd, Colwell, Henry
Nays: None
The Mayor declared the motion passed and the City Attorney read the ordinance for
the second time.
;46.9 Director Osborne, seconded by Henry, moved the rules be further suspended
and the ordinance be placed on third and final reading. The recorded vote was:
Ayes: Lancaster, Noland, Osborne, Sharp, Todd, Colwell, Henry
Nays: None
The Mayor declared the motion passed and the City Attorney read the ordinance for
the third and final time.

Dear Don:
American Biofuels, Inc wishes to purchase Lot 16, Tract B in the
Fayetteville Industrial Park as described on the enclosed sketch
and legal description prepared by McClelland Consulting Engineers.
The company proposes to build a fuel ethanol distillery to produce
approximately 330,000 gallons of anhydrous ethanol per year using
corn or mild as a feedstock. The ethanol will be sold as a gaso-
line additive and distillers grains will be marketed as a high pro-
tein feed supplement. All of the processing equipment will be
housed in a structural steel building and enclosed in security
fencing. The facility will operate continuously and employ 8 full
time employees. The building will be built in accordance with all
City and EPA regulations.
The Industrial Park Committee voted on March 7 to recommend the
sale of this site at a total price of $14,250, which includes a
$2,400 pro -rata share of the sewer line already installed and a
$2,050 set-aside for a pro -rata share of paving Pump Station Road
as previously established.
With the sale of this parcel, it is desirable that the City plan
to pave Pump Station Road at the earliest possible date.

16 North, Range 30 West, Fayetteville, Washington County,
Arkansas, being more particularly described as follows:
Beginning at a point that is South 185.77 feet and East
1,666.05 feet from the NW corner of said Section 26, said
point being on the North right-of-way line of Pump Station
Road; thence leaving said right-of-way N 1°17' E 433.48 feet;
thence N 76°04' E 212.45 feet; thence S 1°17' W 489.12 feet
to the said North right-of-way; thence N 88°45' W 205.00 feet
along said North right-of-way to the point of beginning con-
taining 2.17 acres more or less; subject to a 25 foot wide
utility easement adjacent to and parallel to the North
property line.
