HomeMy WebLinkAbout17-80 RESOLUTION• 1 1 RESOLUTION NO. /%, kO • • A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECt {flOFILMED AN AGREEMENT WITH THE NORTHWEST ARKANSAS REGIONAL PLANNING COMMISSION FOR THE RENDERING OF TECHNICAL AND PROFESSIONAL SERVICES FOR REZONING AND SUBDIVISION PLAT APPROVAL APPLICA- TIONS PRESENTED TO THE FAYETTEVILLE PLANNING COMMISSION. BE IT RESOLVED by the Board of Directors of the City of Fayetteville, Arkansas: That the Mayor and City Clerk are hereby authorized and directed to execute an agreement with the Northwest Arkansas Regional Planning Commission for the rendering of technical and professional services in connection with rezoning and subdivision plat applications submitted to the Fayetteville Planning Commission. AGREEMENT ;4)1. • This agreement dated this ! day of 1980, between the City of Fayetteville, Arkansas, (herein cal d the "City") and the Northwest Arkansas Regional Planning Commission (herein called the "Contractor"). WITNESSETH: WHEREAS, the City desires to engage the Contractor to render certain technical and professional services hereinafter described for the full and adequate consideration. described hereinafter: NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. EMPLOYMENT OF CONTRACTOR. The City hereby agrees to engage the Contractor and the Contractor hereby agrees to perform the services hereinafter set forth. 2. AREA COVERED. The services provided under ✓ espect to the planning Contractor shall this Contract in area of the City perform all the necessary connection with and of Fayetteville, Arkansas. 3. SCOPE OF SERVICES. The Contractor agrees to make available t o the City the services of its staff for the technical review, assistance, and recommendation of zoning and subdivision applications scheduled for hearing by the City's Planning Commission. The Contractor will advise the Fayetteville Planning Commission on sound planning practice, as well as train City staff to assume planning responsibilities. The Contractor, in addition, will advise the City on policies and procedures pertaining to the regulation of land use Special planning studies will be made for the City by the Contractor upon written request from the Fayetteville Planning Commission. 4. TIME OF PERFORMANCE. The services of the Contractor are t o commence as soon as practicable after the execution of the Contract and shall be undertaken and completed in such sequence as to assure their expeditious completion in the light of the purposes of the Contract, but in any event this Contract shall have duration of five (5) years from the execution date. This Contract may be renewed by the City prior to the January 1 preceding the Contract's expiration date. 5. PERSONNEL. The Contractor represents that he has, or will secure, all personnel required in performing the services ✓ equired under this Contract. • • • • • • 6 COMPENSATION. The charges to the City shall be as fdllows: A. Personnel Costs carried by the Contractor including salary, social security, and one-half of insurance cost. This rate will be negotiated annually by the Contractor with the City on January 1. Transportation costs of the Contractor's staff will be at a rate negotiated by the Contractor with the City. Periodic adjustments, as agreed upon by the parties, may be made due to inflation. C. Costs for any and all other exependitures made by the Contractor in the performance of its services. 7. METHOD OF PAYMENT. The Contractor shall present the City with a monthly itemized statement of charges and the City shall make payment within twenty (20) days after such presentation. 8. TERMINATION. Provided two (2) months prior notice is given, this Contract may be cancelled by either party as of the following January 1.
