A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A COST SHARING AGREEMENT WITH CHARM HOMES,
INC., FOR THE CONSTRUCTION OF SIDEWALKS IN REGENCY
NORTH SUBDIVISION.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized
and directed to execute a:cost sharing agreement with Charm
Homes, Inc. for the construction of sidewalks in Regency
North Subdivision. A copy of the agreement authorized for
execution hereby is attached hereto, marked Exhibit "A" and
made a part hereof.

AGREEMENT
THIS AGREEMENT executed this `A() day of
1980, by and between the City of Fayetteville,
hereinafter called the "City" and Charm Homes,
called the "Developer".

WHEREAS, the Developer is developing Regency North
Subdivision in the City of Fayetteville; and
WHEREAS, the Developer and the City desire to enter
into -an agreement to provide for construction of sidewalks
to serve said subdivision.
NOW,
contained
follows:
THEREFORE, in consideration of the mutual covenants
herein, the City and the Developer hereby agree as
1. The Developer shall construct to
specifications a sidewalk along the south
Road where said road abutts Regency North
standard City
side of Appleby
Subdivision.
2. The City shall pay towarnhe'cost.omf,constructing
said sidewalk the sum of $3,564.00.

3. The Developer shall bear the full cost of all base
preparation work.
4. The City shall be responsible for spanning the
drainage ditch located west of the main entrance to Regency
North Subdivision. Said spanning shall be constructed at
such time as the City may determine.
5. The Developer shall bear all engineering and landscaping
costs and any additional costs which the City does not expressly
agree to assume under this Agreement.
6. This Agreement shall be binding upon the parties
hereto and upon their heirs, successors and assigns.
IN WITNESS WHEREOF, the parties have executed this
Agreement on the date first above written.
