A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
CHANGE ORDER NUMBER ONE WITH BENNETT CONSTRUCTION COMPANY FOR
IMPROVEMENTS TO THE POLLUTION CONTROL PLANT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized and
directed to execute change order number one with Bennett
Construction Company for improvements to the Pollution Control
Plant. A copy of the change order authorized for execution hereby
is attached hereto marked Exhibit "A" and made a part hereof.

The Contract dated 26 February, 1979, between the City of Fayetteville, Arkansas,
and Bennett Construction Company, Inc., Springdale, Arkansas, for improvements
to the Fayetteville wastewater treatment plant, is changed in the following
particulars.
Whereas the City of Fayetteville has an urgent need to provide for aeration of
the effluent discharge from the municipal wastewater treatment plant prior to
discharge to the White River, the Contractor, Bennett Construction Company, Inc.,
is authorized to provide all labor and materials as required to construct a
side -stream pumping injector system for the purpose of increasing the oxygen
content of the wastewater effluent, in accordance with the plans executed by the
Engineer and attached hereto and in accordance with this Change Order.
In brief, the work includes the following:
1. Fabricate the pump base and install pump and motor, including all
electrical starting and control equipment. The turbine pump and motor
is to be furnished by the City.
2. Furnish and install all piping, valves, header and eductor system
within the plant yard and within the existing chlorine contact chamber,
as detailed on the plans.
3. Furnish materials for and construct concrete foundation and unloading
slab for oxygen storage tank (said tank to be furnished and installed
by others) .
4. Furnish and install a submersible sump pump within the existing
transfer pit.
5. Remove, by sawing, the concrete roof of the chlorine contact tank to
the lines detailed by the Engineer. Concrete shall be disposed of on
City property at a location as designated by the Fayetteville City
Engineer.
All of the work set out above shall be performed on a force account basis under
the times and rates in force under the Contract of 26 February, 1979.
It is further agreed that the total cost for the work performed under this Change
Order, as shown on the plans or herein described, shall not exceed the sum of
$40,839.00.
All provisions of the original Contract shall not be changed, except in the follow-
ing particulars:
1. All excavation shall be performed by Bennett Construction Company.
2.. The use of small tools by the Contractor shall be billed on a monthly
basis. However, the total material charge for the work performed under
this Change Order section shall not exceed $500.00.

1983, by and between the City of Fayetteville, Arkansas,
hereinafter called "the City," and Raymond Sizemore, hereinafter
called "the Contractor."
TMEREAS, the City of Fayetteville desires to construct
a noise barrier at the Fayetteville Municipal Airport (Drake
Field); and
TMEREAS, the Contractor has submitted a proposal to the
City under which the Contractor would perform all coordination
for the construction of said noise barrier and would provide III'
all necessary labor, excluding the drilling and setting of
post holes, according to plans and specifications provided
by Engineering Services, Inc. of Springdale, Arkansas; and
ITHEREAS, said proposal has been accepted by the City.
NOU, THEREFORE, in consideration of the mutual covenants
contained herein, the parties hereby agree as follows:
1. The Contractor shall perform all coordination for
the construction of a noise barrier at the Fayetteville
Municipal Airport (Drake Field), according to plans and
specifications prepared by Engineering Services, Inc, of
Springdale, Arkansas, with said barrier to be located at a
site specified by the City; provided, the Contractor shall
be under no obligation to provide the labor,
necessary.to
drill post holes and set posts but will provide assistance
to insure that all posts are plum; and, the Contractor shall
be responsible for assuring that all posts are plum. The
City agrees to provide the Contractor with all necessary

2. The Contractor shall commence construction upon'
receipt of a notice to proceed from the City and shall
complete construction on or before December 31, 1983. Time
