A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO INSTITUTE EMINENT DOMAIN PROCEEDINGS TO CONDEMN EASEMENTS
NECESSARY TO RELOCATE UTILITY LINES IN CONNECTION WITH THE
WIDENING AND IMPROVEMENT OF SOUTH SCHOOL AVENUE FROM ARCHIBALD MICROFILMED

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
That the City Attorney is hereby authorized and directed
to institute eminent domain proceedings to condemn the easements
described in "Exhibits 1 through 1 " attached hereto and made
a part hereof for the purpose of relocating utility lines in
connection with widening and improving of South School Avenue
from Archibald Yell to U. S. Highway 71 By -Pass.

a municipal corporation, and to all public utility companies (including
cable television companies) providing utility service within:.the_City of
Fayetteville, a perpetual easement for the purpose of constructing,
maintaining, repairing and replacing a public street and public utility
lines (including cable television lines), to -wit:
EASEMENT DESCRIPTION: A permanent easement of 10 feet of equal and uniform width off of the
entire west side of the following described real estate and a temporary construction easement -
of 40 feet of equal and uniform width off the entire west side of the following described
real estate.
PROPERTY DESCRIPTION: A part of the Northwest Quarter of the Northeast Quarter of Section
Twenty-eight (28), in Township Sixteen (16) North of Range Thirty (30) West, more particula0rly
described as follows: Beginning at a point which is two hundred fifty (250) feet South 14
West of a point which is twenty-nine and five -sixth (29 5/6) rods East of the Northwest
corner of said forty acre tract, said point being on the East side of the former right of way
of the Fayetteville -Greenland Public Road, and running, thence South 70 1/2° East three
hundred (300) feet; thence South 15 1/2° West two hundred twenty-one (221) feet; thence
North 70 1/2° West three hundred (300) feet to the East side of said Public Road as formerly
located; thence in a Northeasterly direction following the East side of said public road as
formerly located two hundred twenty-one (221) feet, more or less, to the place of beginning.

10' East 437 feet to the West line of U.S. Highway 71; thence South 8° West 370 feet; thence
North 89° 19' West 431 feet to the point of beginning and containing 3.52 acres more or less.
EASEMENT DESCRIPTION: A permanent easement of 20 feet of equal and uniform width more parti-
cularly described as follows: Beginning at the Northeast corner of the above-described real
estate and running thence South 86° 10' West 20.5 feet; thence South 80 West 308 feet; thence
East 20 feet to the West line of U.S. Highway 71; thence North 8° East 308 feet to the point
of beginning. Also, a temporary construction easement of 20 feet of equal and uniform width
parallel and adiacent to the above-described 'Permanent easement.
