SO • • • A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A WARRANTY DEED CONVEYING CERTAIN PROPERTY TO CAMPBELL SOUP COMPANY IN EXCHANGE FOR PROPERTY NEEDED TO IMPROVE U. S. HIGHWAYS 62 and 71B. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute the Warranty Deed attached hereto and marked Exhibit "A" and made a part hereof conveying certain property to Campbell Soup Company in exchange for property needed by the City to improve U. S. Highways 62 and 71B. Section 2. That this Resolution shall be effective upon receipt from Campbell Soup Company of a sum of money equivalent to that paid said Company by the Arkansas State Highway and Transportation Department for right-of-way necessary to improve U. DRAWER F 72701 Mr. Ron Hall, Plant Manager Campbell Soup Company 1100 W. 15th Street Fayetteville, AR 72701 Dear Mr. Hall: June 8, 19794 _ 01152-7700 • r ,-; _„ • The Fayetteville City Board of Directors, at their regular meeting held on June 5, 1979, approved the proposed property exchange between the City of Fayetteville and Campbell Soup Company by which the City will deed to the ' Campbell Soup Company the residual portion of the William Neu property at the northwest corner of the intersection of Sixth Street and School Avenue, in the City of Fayetteville, for the necessary right-of-way dedications along School Avenue and Sixth Street on the Campbell Soup property. If it is agreeable with you, we will give Campbell Soup Company immediate access to the William Neu property just as soon as the building is vacated and you may use it in any manner you deem'appropriate. Just as soon as the High- way Department appraises the right-of-way parcel along your south boundary and presents you with a check in payment therefore, we will give you a deed to the lieu property if you will turn over the amount of the right-of-way check to us. In the interim, we request that Campbell Soup Company execute the right- of-way easement along the east portion of your property and the triangular section on the corner so that we might proceed with the Business Route 71 widening project. For your information, the City of Fayetteville is paying William Neu the sum of $13,800 for his property; plus an additional $1,200 relocation expense. Grimes City Manager • • • ^*7 t at: t WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS: That the City of Fayetteville, Arkansas, a municipal corporation, for and in consideration of the sum of One Dollar ($1.00) and other valuable consideration to it in hand paid by Campbell Soup Company, a New Jersey Corporation, do hereby grant, bargain and sell unto the said Campbell Soup Company, and to its heirs and assigns, the following described land, situate in Washington County, State of Arkansas, to -wit: A part of Lots Numbered Eight (8) and Nine (9) in Block Numbered Fourteen (14) of Ferguson's Addition to the City of Fayetteville, as designated upon the recordec plat of said addition, and more particularly described as follows: Beginning at the Southeast corner of said Lot 8, and running, thence North thirteen (13) feet; thence West twenty-five (25) feet; thence South two (2) feet; thence West forty-five (45) feet; thence South twenty-one (21) feet; thence East seventy (70) feet; thence North ten (10) feet to the place of beginning; Less and except 5 feet of equal and uniform width off the entire East side of the above described real estate. DRAWER F 72701 (5011 521-7700 May 8, 1979 Campbell Soup Company 1100 W. 15th Street Fayetteville, AR 72701 Attn: Mr. Ron Hall, Plant Manager Dear Mr. Hall: This letter is to confirm our offer to exchange the residual property of the William Neu Fix -It Shop, which is 65 feet east and west and 21-23 feet north and south which adjoins your property at the northwest corner of Sixth Street and School Avenue, for five feet of equal and uniform width off the entire south and east side of your property and a turning radius at the corner of the intersection, a total of 1124 square feet. The amount of land we will deed to you is 1405 square feet. The improving of Highway 62 is a separate project from the improving and widening of 7113. The City of Fayetteville is responsible for the 716 improve- ment and the Arkansas State Highway Department will purchase the right-of-way for the 62 project. We would ask you to remit to the City the amount of the payment for the south five feet of your property or the amount paid you by the Arkansas State Highway for that right-of-way.
