HomeMy WebLinkAbout26-79 RESOLUTION1 • • • • RESOLUTION N0. o((j-'79 • A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF FAYETTEVILLE TO REQUEST STATE -AID STREET FUNDS FROM THE DIRECTOR OF HIGHWAYS AND TRANSPORTATION WHEREAS, Act 436 of 1979 appropriated special funds to the Municipal Aid fund to be distributed in accordance with Act 5 (a) of the Arkansas Highway Revenue Distribution Law, and WHEREAS, the expressed funds and for the City understands that these funds are to be used for purposes of matching the City's share of State -Aid Street city street maintenance, and WHEREAS, the City of Fayetteville will use its share of funds re- ceived from the Municipal Aid fund to match all available monies due it from the State -Aid Street Account, and WHEREAS, the City certifies that an emergency exists and it will use all funds made available under this Act to finance city-wide mainten- ance, and WHEREAS, the City hereby certifies that it will maintain adequate records to document all expenditures of these funds for maintenance as set forth in this Resolution and make these records available to audit by the State upon request. NOW THEREFORE, the Mayor of the City of Fayetteville is hereby directed to request in accordance with this Resolution the City's fair share of funds presently maintained in the State -Aid Street Account. This is to notify you of our intent to match all funds so available with money previously allocated to us from the Municipal Aid funds in accordance with Act 436 of 1979. ZIMMERMAN SUBJECT: STREET FUNDS D CITY L1G•18.1EllS OFFICE CITY OF FAYETTEVILLE On approximately March 28th your City Treasurer will receive a check for your city's share of $2,250,000.00 from the state sur- plus appropriated by Act 436 of 1979 (approximately $1.77 per person to your city). We recommend that this money be deposited in a special Street Fund Maintenance Account or at least accounted for separately from your other street funds. Under the provisions of Act 436 of 1979, you can use this money to match your city's share of the state street aid money accumulated for the past three (3) years totaling $3,164,460.00 and appropriated by Act 199 of 1979 (approximately $2.54 per person to your city). Provisions of Act 436 of 1979 permit you to use all these funds for maintenance of city streets and waive all provisions of the state street aid bill requiring the money to be used for construction. Your League staff is recommending that all this money be used for city-wide street maintenance; thereby, you can receive the money almost immediately and begin patching potholes and doing other street maintenance. If you want to schedule construction projects with or without Federal Aid, we would recommend that you use your monthly alloca- tions of street turnback. This procedure will eliminate as much "red tape" as possible. Enclosed is information on the procedures which need to be followed to obtain the Street -Aid funds. We suggest that you secure passage of the enclosed resolution at your next Council or Board meeting and then immediately send it and the letter (sample enclosed) to Mr. Henry Gray on your municipality's letterhead. If we can be of further assistance, please call on us. Encls/hw PROOG RIP ITN R 0 MN MGM • • PROCEDURES'FOR'CITIES TO OBTAIN STATE -AID STREET'FUNDB AVAILABLE THROUGH ACT 436 of 1979 . OF THE 72ND GENERAL ASSEMBLY 1. The mayor will be responsible for obtaining the Resolution from the City Board or Council (draft Resolution attached) authorizing him to act in behalf of the City to obtain State Aid Street funds as appropriated by Act 199 of 1979x. A copy of this Resolution will then be transmitted3too Mr. Henry Gray, Director of the Arkansas State HigWway; and Transportation Department, certifying that alimonies obtained under this legislation will be utilized €or_aty- wide maintenance and further that all records of expendi- tures will be available for State audit. Upon receipt of the properly documented request from the City for city-wide maintenance, the Accounting Division will prepare a voucher and send the City a check. •
