A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO INSTITUTE
EMINENT DOMAIN PROCEEDINGS TO CONDEMN EASEMENTS NECESSARY
FOR CONSTRUCTION OF A SIDEWALK ALONG GARLAND AVENUE.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the City Attorney is hereby authorized and directed
to institute eminent domain proceedings to condemn those
easements described in Exhibits "A" and "B" attached hereto,
and made a part hereof, which easements are necessary for
the construction of a sidewalk along Garland Avenue.

PERMANENT EASEMENT DESCRIPTION:
Ten (10) feet of equal and uniform width along the East
side of the following described property: Lot 1, Maxwell
Addition to the City of Fayetteville, Arkansas; the East
line of said easement being the West right-of-way line
of Arkansas State Highway 112 as presently monumented.
TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION:
Fifteen (15) feet of equal and uniform width along the
West side of the above described permanent easement.
APPARENT OWNER:
John Harris and Mary Harris, husband and wife

PERMANENT EASEMENT DESCRIPTION:
Five (5) feet of equal and uniform width along the
East side of the following described property:
Part of the South half (S 1/2) of the Northeast
quarter (NE 1/4) of the Northeast quarter (NE 1/4)
of Section A, Township sixteen (16) North, Range
thirty (30) West being more particularly described
as follows: Beginning one hundred five (105) feet
South of the Northeast corner of the above described
twenty (20)acre tract; thence running South one
hundred five (105) feet; thence West four hundred
twenty (420) feet; thence North one hundred five
(105) feet; thence East four hundred twenty (420)
feet to the point of beginning, containing one (1)
acre more or less, less any part taken up by Arkansas
State Highway 112. The East line of said easement
being the West right-of-way line of Arkansas State
Highway 112 as presently monumented.
TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION:
Fifteen (15) feet of equal and uniform width along the
West side of the above described permanent easement.
