HomeMy WebLinkAbout113-79 RESOLUTION• RESOLUTION NO./13-19 • A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO INSTITUTE EMINENT DOMAIN PROCEEDINGS TO CONDEMN EASEMENTS NECESSARY FOR CONSTRUCTION OF A SIDEWALK ALONG GARLAND AVENUE. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the City Attorney is hereby authorized and directed to institute eminent domain proceedings to condemn those easements described in Exhibits "A" and "B" attached hereto, and made a part hereof, which easements are necessary for the construction of a sidewalk along Garland Avenue. TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION: Fifteen (15) feet of equal and uniform width along the West side of the above described permanent easement. APPARENT OWNER: John Harris and Mary Harris, husband and wife EXHIBIT "B" PERMANENT EASEMENT DESCRIPTION: Five (5) feet of equal and uniform width along the East side of the following described property: Part of the South half (S 1/2) of the Northeast quarter (NE 1/4) of the Northeast quarter (NE 1/4) of Section A, Township sixteen (16) North, Range thirty (30) West being more particularly described as follows: Beginning one hundred five (105) feet South of the Northeast corner of the above described twenty (20)acre tract; thence running South one hundred five (105) feet; thence West four hundred twenty (420) feet; thence North one hundred five (105) feet; thence East four hundred twenty (420) feet to the point of beginning, containing one (1) acre more or less, less any part taken up by Arkansas State Highway 112.
