A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A WARRANTY DEED CONVEYING THE TRAFFIC ISLANDS AT
THE ENTRANCE TO - HYLAND _ PARK PHASE I TO THE HIGHLAND PARK
HOME OWNERS ASSOCIATION, INC. PHASE I.
BE IT RESOLVED BY the Board of Directors of the City
of Fayetteville, Arkansas:
That the Mayor and City Clerk are hereby authorized
and directed to execute a warranty deed conveying the
traffic islands at the entrance to Nyih'nd:, Park Phase I
to the Hyland-. Park Home Owners Association, Inc. Phase
I. A copy of said deed, marked Exhibit "A", is attached
hereto and made a part hereof. 11

WARRANTY DEED
(CORPORATION)
KNOW ALL MEN BY THESE PRESENTS:
That the City of Fayetteville
a corporation organized under and by virtue of
the laws of the State of Arkansas, by its Mayor
and City Clerk duly authorized by proper resolution
of its Board of Directors, for the consideration
of the sum of One Dollar, in hand paid by
Hyland Park Home Owner's Association, Inc. Phase I
the receipt of which is hereby acknowledged, does
grant, bargain, sell and convey unto the said
Hyland Park Home Owner's Association, Inc. Phase I
andunto its heirs and assigns forever, the
following described land, situate in the County
of Washington
State of Arkansas, to -wit:
The islands at the entrance to Hyland Park, Fayetteville, Arkansas.
Descriptions run along the back of the concrete curb and gutter
around each island. Said islands and part of the NE;, SE; of
Section 11, Township 16 North, Range 30 West, Washington County,
Arkansas, more particularly described as follows:
Beginning South 1253.44 feet and West 626.04 feet from the NE
corner of the said SE;, Section 11; thence 8.19 feet on a curve
to the right having a radius of 5.43 feet; thence S 06° 16' 56"W
2.91 feet; thence 9.76 feet on a curve to the right having a radius
of 6.43 feet; thence S 80° 41' 58"W 69.92 feet; thence 11.37 feet
on a curve to the right having a radius of 6.98 feet; thence NOS
57' 07"W 6.68 feet; thence 14.76 feet on a curve to the right having
a radius of 9.07 feet; thence N87° 16' 37"E 68.63 feet to the point
of beginning containing 0.04 acres more or less.
AND ALSO beginning South 1259.46 feet and West 765.90 feet from
the NE corner of the SE; of said Section 11, thence 17.26 feet on
a curve to the right having a radius of 11.33 feet; thence S05°
29' 29"E 7.15 feet; thence 14.98 feet on a curve to the right having
a radius of 9.99 feet; thence S 80° 23' 17"W 59.52 feet, thence
25.14 feet on a curve to the right having a radius of 15.09 feet,
thence N04° 09' 55"W 6.86 feet; thence 21.79 feet on a curve to the
right having a radius of 13.65 feet; thence N 87° 15' 58"E 59.63 feet
to the point of beginning containing 0.06 acres more or less.
AND ALSO beginning South 1264.95 feet and West 885.35 feet from the
NE corner of the SE; of said Section 11, thence 23.38 feet on a curve
to the right having a radius of 14.86 feet; thence S02° 20' 13"E
12.76 feet, thence 22.95 feet on a curve to the right having a radius
of 15.20 feet; thence 87.42 feet on a curve to the right having a
radius of 246.50 feet; thence 45.54 feet on a curve to the right
having a radius of 31.00 feet; thence 2.31 feet on a curve to the
right having a radius of 9.0 feet; thence N 87° 31' 39"E 107.60 feet
to the point of beginning containing 0.11 acres more or less.

TO HAVE AND TO HOLD The same unto the said Hyland Park Home
Owner's Association, Inc. Phase I and unto its
heirs and assigns forever, with all appurtenances thereunto belonging.
And said corporation hereby covenants with the said grantee that
it will forever warrant and defend the title to said lands against
all lawful claims whatever.
IN TESTIMONY WHEREOF, The name of the grantor is hereunto affixed
by its Mayor and its seal affixed by its City Clerk, this 16th
day of January 11979

ACKNOWLEDGMENT

On this 16th day of January , 19 79 ,
before undersigned, a Notary Public, duly commissioned, qualified
and acting, within and for the said County and State appeared in
person the within named David R. Malone and Angela R. Medlock
to me personally known, who stated that they were the. Mayor
and City Clerk of the City of Fayetteville, Arkansas
a corporation, and were duly authorized in their respective capacities
to execute the foregoing instrument for and in the name and behalf
of said corporation, and further stated and acknowledged that they
had so signed, executed and delivered said instrument for the
consideration, uses and purposes therein mentioned and set forth.
IN TESTIMONY WHEREOF, I have hereunto set my hand and official
seal this 16th day of January , 19 79
