RESOLUTION NO. 95-7.7
A RESOLUTION AUTHORIZING THE EMPLOYMENT OF PUTMAN, DAVIS,
BASSETT, COX, AND WRIGHT, ATTORNEYS AT LAW, TO REPRESENT THE CITY
OF FAYETTEVILLE IN A CONDEMNATION CASE IN WHICH THE CITY ATTORNEY
HAS A CONFLICT OF INTEREST.
WHEREAS, the Board of Directors has authorized the condemnation
of the following described property for the purpose of constructing
thereon a public continuing education facility and convention center;
and
Whereas, the law firm in which the City Attorney is a partner
has a leasehold interest in said property, and it would be a con-
flict of interest for the City Attorney to represent the City in the
condemnation of said property.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby authorizes the employment
of Putman, Davis, Bassett, Cox and Wright, Attorneys at Law, to
represent the City of Fayetteville, Arkansas, in an eminent domain
proceeding to condemn the following described property:
Part of Lots Six (6) and Seven (7) in Block Fifteen
(15), in the original town (now City) of Fayetteville,
Arkansas, more particularly described as follows, to -
wit: Beginning at the Southeast corner of Lot Seven
(7), and run thence North 106.5 feet, thence West
35.75 feet, thence South 106.5 feet, thence East 35.75
feet to the point of beginning.
BE IT FURTHER RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE, ARKANSAS, that the aforesaid law firm shall be paid
at the rate of $45.00 per hour plus expenses for services rendered
in connection with the aforesaid eminent domain proceeding.

A RESOLUTION AUTHORIZING THE CONDEMNATION OF PROPERTY
OWNED BY CARLOS B. HILL AND IVAN L. HILL ON CENTER STREET
FOR THE PURPOSE OF CONSTRUCTING A PUBLIC CONVENTION CENTER.
Whereas, by virtue of Ark. Stat. 35-901 et seq. muni-
cipal corporations are authorized to acquire by eminent domain
fee simple title to real property for the purpose of construc-
ting public buildings; and
Whereas, the City of Fayetteville, Arkansas, proposes to
construct a public convention center at the northeast corner
of the intersection of East Avenue and Center Street which
center will be used primarily for continuing education pur-
poses; and
Whereas, Carlos B. Hill and Ivan L. Hill own the property
hereinafter described, which property occupies a portion of the
site where the aforesaid convention center is proposed to be
constructed; and
Whereas, theCity has not been able to acquire said property
by negotiation with the owners thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the following described property be, and the same is
hereby, authorized for condemnation for the purpose of con-
structing thereon a public convention center:
Part of Lots Six (6) and Seven (7) in Block Fifteen
(15) in the original town (now City) of Fayetteville,
Arkansas, more particularly described as follows, to -
