RESOLUTION NO. 90-77
A RESOLUTION DECLARING TWO VACANCIES ON THE BOARD OF
IMPROVEMENT OF STREET IMPROVEMENT DISTRICT NO. 77-1; AND
APPOINTING JERE BLOCK AND DAVID ALBERT TO FILL SAID VACANCIES.
WHEREAS, by Ordinance No. 2328, the Fayetteville Board of
Directors established Street Improvement District No. 77-1 and
appointed Calvin Edens and L. Grady Cowden as Commissioners to
serve on the Board of Improvement for said district, and
WHEREAS, said Calvin Edens and L. Grady Cowden failed
to take the oath of office required by Section 20 of Article
19 of the Constitution of the State of Arkansas and failed to file
said oath in the office the City Clerk within ten days after
their appointment as required by Ark. Stat. 20-113; and
WHEREAS, Ark. Stat. 20-115 provides that if any member of
the Board of Improvements shall fail to take the oath and to
file the same in the office of the Clerk within the time allowed,
he shall be taken to have declined the office, and the City
Council shall at once appoint another person in his place.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby declares
vacant the positions of Calvin Edens and L. Grady Cowden as
Commissioners on the Board of Improvement of Street Improvement
District No. 77-1.
Section 2. That the Board of Directors hereby appoints
Jere Brock and David Albert, property owners within Street
Improvments District No. 77-1, as Commissioners to serve on the
Board of Improvement for said district.
