A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO INSTITUTE EMINENT DOMAIN PROCEEDINGS TO CONDEMN A WATER
LINE EASEMENT FOR THE CONSTRUCTION OF A PUBLIC WATER LINE ALONG
PORTER ROAD.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the City Attorney be, and he is hereby, authorized
and directed to institute eminent domain proceedings to condemn
the following described easement for the purpose of constructing
a public water line along Porter Road across property owned by
Eunice D. Porter and James O. Porter and Dale Karr and Ruth A.
Karr:
A permanent easement 20 feet of equal and uniform width
and a temporary construction easement of 30 feet of equal
and uniform width off the entire East side of the following
described real estate:
Part of the Southeast Quarter of the Southeast Quarter
of Section 6, Township 16 North, Range 30 West and being
more particularly described as follows: Beginning at a
point 30 feet West of the Northeast corner of said 40 acre
tract, and running thence West 87.2 feet to a point on the
Easterly right of way line of U. S. Highway 71 By -Pass,
thence South 31° 03' West along said proposed right of way
line 117.7 feet; thence East 149.3 feet; thence North
100 feet to the point of beginning and a part of the
South Half of the Northeast Quarter of the Southeast
Quarter of Section 6, Township 16 North, Range 30 West
and being more particularly described as follows: Be-
ginning at a point 30 feet West of the Southeast corner
of said 40 acre tract and running thence West 87.2 feet
to a point on the Easterly right of way line of U. S.
Highway 71 By -Pass, thence Northerly along said right of
way line to a point due North of the beginning point,
thence South to the point of beginning.
