RESOLUTION NO. 60--4717
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO INSTITUTE EMINENT DOMAIN PROCEEDINGS TO CONDEMN A SEWER LINE
EASEMENT FOR THE CONSTRUCTION OF A PUBLIC SEWER LINE ACROSS
PROPERTY OWNED BY ANTHONY DE PALMA WEST OF ARKANSAS HIGHWAY 265.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the City Attorney be, and he is hereby, authorized
and directed to institute eminent domain proceedings to condemn
the following described easement for the purpose of constructing
a public sewer line across property owned by Anthony De Palma
West of Arkansas Highway 265:
A part of the SE/4 of the SW/4 of Section 11, Township
16 North, Range 30 West, described as a 25 foot water
and/or sewer easement of equal and uniform width, said
easement being more particularly described as 12.5 feet
either side of a centerline that begins at a point 575
feet North of the Southwest corner of said 40 acre
tract, running thence S 440 43' 08" E 175.0 feet; thence
S 370 08' 08" E 91.0 feet; thence S 2° 41' 51" W 282.0
feet; thence S 55° 38' 08" E 170.0 feet to a point on
the South line of said 40 acre tract containing 0.41 acres,
more or less, City of Fayetteville, Washington County,
Arkansas, together with a 25 foot temporary construction
easement parallel to and contiguous with the West side of
the permanent easement.
