RESOLUTION NO.
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A CONTRACT WITH JOHNSON PLUMBING & HEATING COMPANY
FOR THE INSTALLATION OF SEWER YARD LINES.
BE IT REVOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

That the Mayor and City Clerk be, and they herebY are,
authorized and directed to execute a contract with Johnson:
Plumbing & Heating Company for the installation of yarclifines
at 621 Porter Road, 1433 Porter Road and 1620 Porter Road. A
copy of said contract, marked Exhibit "A", is attached hereto
and made a part hereof.

CONTRACT
THIS AGREEMENT is made this QC day of tl2t4.t. , 1977; between
the City of Fayetteville, hereafter known as "OWNER", and Johnson Plumbing and
Heating Company
of Fayetteville, Arkansas
, hereafter
known as "CONTRACTOR".
For payments and agreements mentioned, the CONTRACTOR agrees with the
OWNER to commence and complete work, designated as 15 sewer taps for the
Community Development Program of the City of Fayetteville, in accordance with
the base bid proposal for Job 77-1 attached hereto and made a part hereof,
hereafter known as the "PROJECT", for the unit price of Four Dollars and 25/100
($4.25) per linear foot, and when encountered rock excavation for
Fifty Dollars and no/1019er cubic yard ($50.00) . The CONTRACTOR
agrees to furnish all materials, supplies, machinery, equipment, tools, super-
intendence, labor, insurance, and other items necessary to complete said
PROJECT in accordance with "Specifications" and "Description of Work".
The CONTRACTOR agrees to commence work under this CONTRACT with FIVE (5)
consecutive calendar days of "Notice to Proceed" from OWNER and to fully com-
plete the PROJECT within sixty (60)
consecutive calendar days. CONTRAC-
TOR agrees to pay, as liquidated damages, the sum of TWENTY-FIVE DOLLARS
($25.00) per each consecutive calendar day after contract date of completion.
The OWNER agrees to pay CONTRACTOR in

this CONTRACT at an end, in which event, the OWNER shall not be liable to the
CONTRACTOR for any work or (2) to require the surety bond to be surrendered and
carry out CONTRACT of CONTRACTOR. The CONTRACTOR shall be paid for that portion
of work completed only after PROJECT is completed.
CONTRACTOR agrees to hold CITY harmless from any and all claims and demands
arising out of or connected with the performance of CONTRACTOR'S obligations
hereunder, or as the result of anything claimed to be done or omitted to be
done by CONTRACTOR.
This CONTRACT shall be binding upon the heirs, representatives, successors
