A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY
CLERK TO EXECUTE A GRANT AGREEMENT AND CONTRACT WITH THE ARKANSAS
PUBLIC SAFETY PROGRAM FOR FUNDS TO IMPROVE INTERSECTION SIGNING.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute a Grant Agreement and
Contract with the Arkansas Public Safety Program : to
improve intersection signing. A copy of said Grant Agreement
and Contract, marked Exhibits "A" and "B", respectively, are
attached hereto and made a part hereof.

CONSTRUCTION AGREEMENT
1. This evidences an agreement between the City of Fayetteville
Office of Public Safety, and Arkansas State Highway Department for the up-
grading of signing on city streets which are not a part of the Federal Aid
System.

2. Under the 1973 Federal Aid highway Act, Federal funds are made available
which may be used for payment in part for th•_ work contemplated by this agree-
ment under the condition that not less than ten percent of the cost of the con-
struction and construction engineering, plus the'full cost of all nonparticipating
items be borne by the City and the work be performed in accordance with plans and -
specifications approved by the Arkansas State highway Department and the Office
of Public Safety and the work supervised by the Arkansas State Highway Department.
3. The plans and specifications for the upgrading of signing on city streets
which arc not a part of the Federal Aid System have been approved by the Arkansas
Highway Department and the Office of Public Safety and are on file in both offices
in Little Rock and in the office of the Mayor of the City and said plans have
been ap_,roved and accepted by the City.
4. The City has elected to perform the proposed work with its own forces,
equipment, and materials which work is described as follows:

S. In furtherance of this project, the City, as Sponsor of this project, has
made a Performance Bond, executed by a Bonding Company authorized to do ''
business in this State, in the penal sum of
$13,200.61
which is 100 percent
of the estimated cost of said work and the materials entering into said improve -
sant. Furthermore; the City has given the Arkansas State highway Department a
check payable to said Department in the amount of $139.94 which is the
City's portion of construction engineering.
6. The City, as Contractor, agrees to perform this work in accordance with
the attached specifications and at the unit prices shown in the attached proposal
schedule.
As the work undertaken by the City hereunder progresses, the Arkansas State
Highway -Department in its supervision thereof will from time to time issue
partial estimates, based on work performed at the Negotiated Unit Prices until
the work is completed and will credit to or pay to the City from Federal funds
received for account of this protect, ninety percent of such estimates. Final
payment will be madeupon the completion and acceptance of said project, subject
to correction for changes made in the final voucher as paid by the Federal High-
way Administration.

Should the said City fail to complete the work in an acceptable manner, or
default in any requirement of it hereunder, the Arkansas State HIighway Depart-
ment shall have the right to complete all or any portion of the work with means
at its conmand and pay for same from funds to be realized from the Performance
toad set up in paragraph No. 5.
In no case can any portion of the construction cost of this project to
borne by the Arkansas State highway Department.
S. The City agrees upon completion of the project to assume the maintenance
of the Installation by City forces anchor others in accordance with applicable
