A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A MODIFICATION OF AGREEMENT FOR ARCHITECTURAL SERVICES
WITH PAUL YOUNG, JR. d/b/a PAUL YOUNG AND ASSOCIATES FOR
ARCHITECTURAL SERVICES FOR ALTERATIONS AND ADDITIONS TO THE
TERMINAL BUILDING AT DRAKE FIELD.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they are hereby,
authorized and directed to execute a Modification of Agreement
for Architectural Services with Paul Young, Jr. d/b/a Paul
Young and Associates for architectural services for alterations
and additions to the Terminal Building at Drake Field. A
copy of said Modification of Agreement for Architectural
Services is attached hereto, marked Exhibit "A", and made a
part hereof.

That the Mayor and City Clerk be, and they are hereby,
authorized and directed to execute a Modification of Agreement
for Architectural Services with Paul Young, Jr. d/b/a Paul
Young and Associates for architectural services for alterations
and additions to the Terminal Building at Drake Field. A
copy of said Modification of Agreement for Architectural
Services is attached hereto, marked Exhibit "A", and made a
part hereof.

I acknowledge that this certificate is to be furnished
to the Federal Aviation Administration of the United States
Department of Transportation, in connection with this contract
involving participation of Airport Development Aid Program
(ADAP) funds and is subject to applicable state and Federal
laws, both criminal and civil.

on their use. In the event any of the above documents
are reused by the Owner, the nameplate will be removed
and the Architect will be released and held harmless of
subsequent liabilities.
12. Said agreement is hereby amended by adding Article
14 to read as follows:
14. Access to records. The Owner, the Federal
Aviation Administration, the Comptroller -General of the
United States, or any of their duly authorized repre-
sentatives, shall have access to any books, documents,
papers and records of the Architect which are directly
pertinent to work hereunder, for the purpose of making
audit, examination, excerpts and/or transcriptions.
13. Said agreement is hereby amended by adding Article
15 to read as follows:

9. Paragraph 1.2.3 on Page 4 of said agreement is
hereby amended to read as follows:
1.2.3. The duties and responsibilities of such
full-time project representatives shall be as follows:
(a) Review and approve requests for monthly and
final payments to contractors.
(b) Issue certificates of completion to the Owner
or Architect on completed construction contracts.
(c) Provide "as -built" information to the Architect
for preparation of "as -built" drawings of the completed
project.
(d) Supervise testing and inspection; arrange
for, conduct, or witness field, laboratory, or shop
tests of construction materials as required by the
plans and specifications; determine the suitability of
materials on the site and brought to the site to be
used in the construction; interpret the contract plans
and specifications and check the construction activities
• to assure compliance with the intent of the design;
measure, compute, or check quantities of work performed
and quantities of materials in place for partial and
final payment to the contractors; and maintain diaries
and other project records to document the work.
10. Paragraph 5.1.2 on Page 6 of said agreement is
hereby deleted.
11. Article 9 on Page 7 of said agreement is hereby
amended to read as follows:
9. Ownership of documents. Original documents,
such as tracings, plans, specifications and maps,
prepared or obtained under the terms of this agreement
shall be delivered to and become the property of the
' Owner, and basic survey notes and sketches, charts,
computations and other data shall be made available
upon request to the Owner without restriction or limitation
4. That Paragraph II(B) on Page 2 of said agreement is he
amended by adding subparagraph 4 to read as follows:
4. Services of a qualified full-time (resident)
inspector (project representative) at the fixed rate of
$6.00 per hour, not to exceed a total of $8,000.00.
S. Paragraph II on Page 2 of said agreement is hereby
amended by adding paragraph (E) to read as follows:
(E) Overtime architectural services: The con-
struction contract will contain a completion time
expressed in calendar days. Should the construction
require additional time and result in a requirement
for additional services, payment for these services shall
be made in accordance with the provisions of paragraphs
II(B) and II(E) of this agreement.
6. Article I of said Contract is hereby amended by adding
Paragraph 1.1.22 to read as follows:
1.1.22. Preparing to serve or serving as an
expert witness in connection with any public hearing,
adding Paragraph 1.1.23 to read as follows:
1.1.23. Preparing a set of reproducable record
prints of drawings showing significant changes in the
work made during the construction process, based on
marked -up prints, drawings and other data furnished by
-�- the contractor to the Architect.
Paragraph 1.2.2 on Page 4 of said agreement is hereb
to read as follows:
1.2.2. Such full-time project representative shall

MODIFICATION OF AGREEMENT FOR ARCHITECTURAL SERVICES
This Modification of Agreement for Architectural Services is
made this o?I day of , 1977, by and between the City
of Fayetteville, Arkansas, hereinafter called the "Owner", and
Paul Young, Jr. d/b/a Paul Young fi Associates, hereinafter called
the "Architect"
WHEREAS, the Owner and the Architect have previously entered
into an agreement dated June 21, 1977, attached hereto, marked
Exhibit "A", and made a part hereof, pursuant to which the Architect
has agreed to provide architectural services for alterations and
additions to the terminal building at Drake Field; and
WHEREAS, the Owner and the Architect desire to modify said
Agreement
NOW,
the Owner
as hereinafter provided.
THEREFORE, it is hereby mutually agreed by and between
and the Architect that the aforesaid agreement is hereby
modified as follows:
1. Paragraph II (A) on Page 2 of the Agreement is modified
to read as follows:
(A) For basic services, as described in Paragraph
1.1, basic compensation shall be a fixed lump sum fee of
$45,500.00, provided, if the scope of the project covered
by this agreement substantially exceeds or is substantially
less than a total construction cost of $700,000.00, said
fee shall be adjusted either up or down proportionately.
2. Paragraph II (B) (2) of said Agreement is hereby
amended to read as follows:
