A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A MODIFICATION OF WATER PURCHASE CONTRACT WITH THE
TOWN OF ELKINS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized to
execute a Modification of Water Purchase Contract with the
Town of Elkins. A copy of said Modification of Water Purchase
Contract is attached hereto, marked Exhibit A, and made a part
hereof.

MODIFICATION OF WATER PURCHASE CONTRACT
This agreement made this day of
1977, by and between the City of Fayetteville, Arkansas, a
municipal corporation, hereinafter referred to as the "City"
and the Town of Elkins, Arkansas, a municipal corporation,
hereinafter referred to as the "Town".
WHEREAS, the parties hereto have entered into a Water
Purchase Contract dated July 3, 1967, a copy of which is
attached hereto, marked Exhibit "A", and made a part hereof;
and
WHEREAS, the parties desire to enter into a new agreement
modifying the provisions of said agreement.
NOW, THEREFORE, the City and the Town hereby mutually
agree as follows:
1. That Section A, paragraph 4, of the aforesaid Water
Purchase Contract is hereby modified to read as follows:
4. The City's responsibility for maintenance shall end
at the outlet side of the meter box or vault. Should the
Town desire and request the City to do emergency maintenance
work on the Town's system beyond said point, the City, if
materials and crews are available, will do the work requested
and charge the Town for said work on the basis of cost plus
ten percent for materials, cost plus twenty five percent for
labor, and standard hourly rates for equipment usage as
established by the City's accounting systems or by local
contractors. Emergency maintenance work by City of Fayetteville
forces shall be limited to breaks on cast iron or ductile
iron mains in service at the effective date of this agreement.
2. All provisions of the aforesaid Water Purchase
Contract are incorporated herein and are hereby modified to
conform herewith but in all other respects are to be and
shall continue in full force.
