A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT WITH THE TOWN OF ELKINS PURSUANT TO
WHICH THE CITY OF FAYETTEVILLE WILL PROVIDE NECESSARY
EQUIPMENT, MATERIALS, AND LABOR TO MAKE WATER TAPS IN THE
WATER SYSTEM OF THE TOWN OF ELKINS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk are hereby authorized to
execute a Water Tap Agreement with the Town of Elkins. A
copy of said Agreement, marked Exhibit A, is attached hereto
and made a part hereof.

AGREEMENT
This Agreement executed this
•
day of
1977, by and between the City of Fayetteville, Arkansas, and
the Town of Elkins, Arkansas.
WHEREAS, the Town of Elkins has requested the City of
Fayetteville to provide the necessary equipment, materials,
and labor to make water taps in the water system of the
Town of Elkins;
WHEREAS, the City of Fayetteville has the necessary
equipment, materials, and labor to make said taps; and
WHEREAS, the purpose of this agreement is to set forth
the terms and conditions pursuant to which the City of
Fayetteville will make said taps.
NOW, THEREFORE, in consideration of the mutual convenants
contained herein, it is hereby agreed by and between the
City of Fayetteville and the Town of Elkins as follows:
1. Upon written request by the Town of Elkins to the
City Engineer's office of the City of Fayetteville, the City
of Fayetteville agrees to make water taps in the water
system of the Town of Elkins within a reasonable time from
receipt of said request.
2. All water taps made pursuant to this agreement
shall be made on cast iron or ductile iron only.
3. The Town of Elkins agrees to provide a backhoe and
backhoe operator to perform all necessary excavation work
with said excavation work to be under the supervision of an
authorized representative of the City of Fayetteville.
4. The Town of Elkins shall provide all necessary
easements and rights-of-way and shall provide all necessary
Arkansas Highway Department crossing permits.
5. The City of Fayetteville shall furnish the necessary
tapping machine, and all necessary materials and labor
required to make each tap.

6. For each water tap made by the City of Fayetteville
pursuant to this Agreement, the Town of Elkins agrees to pay
the City of Fayetteville the actual cost of labor, materials,
and equipment involved in making the tap, plus fifteen
percent of said cost. Actual cost of equipment shall be in
accordance with the schedule attached hereto, marked Exhibit
"A", and made a part hereof. Travel time to and from the
work site shall be included when computing the cost of labor
and equipment.
7. The City of Fayetteville agrees to bill the Town of
Elkins monthly for water taps made by the City of Fayetteville
pursuant to this Agreement. The Town of Elkins agrees to
pay each such bill within ten days from the date thereof.
8. The Town of Elkins agrees to indemnify the City of
Fayetteville from any and all loss or damage the City of
Fayetteville may suffer as a result of claims or judgments
against it arising out cf performance of this contract.
9. The City of Fayetteville or the Town of Elkins
shall have the right to terminate this agreement by giving
the other party not less than thirty (30) days notice of
termination.

seals on the date first above written.
