A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A CONTRACT WITH JOHNSON PLUMBING & HEATING COMPANY
FOR THE INSTALLATION OF TEN SEWER TAPS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute a contract with Johnson
Plumbing & Heating Company for the installation of ten sewer
taps in connection with the city's Community Development Program.
A copy of said contract, marked Exhibit "A", is attached hereto
and made a part hereof.

SUBJ: ADDENDUM TO SEPTEMBER 9, 1976, CONTRACT FOR TEN SEWER TAPS AWARDED TO
JOHNSON PLUMBING
An addendum to the September 9, 1976 Sewer Tap Contract has been made consisting
of the following:
Plumbing reworked under the Evans house at 419 Skelton to provide adequate
fall as required to install new sewer yardline. (From previous CD contract)

CONTRACT
THIS AGREEMENT is made this g day of irolfro_c_xy
between the City of Fayetteville, hereafter known as "OWNER", and

For payments and agreements mentioned, the CONTRACTOR agrees with the OWNER
to commence and complete work, designated as ten sewer taps for the Community
Development Program of the City of Fayetteville, in accordance with the base bid
proposal for Job 76-1 attached hereto and made a part hereof, hereafter known as
the "PROJECT," for the unit price of four dollars and twenty five -cents ($4.25)
per linear foot, and when encountered rock excavation for forty dollars per cubic
yard ($40.00). The CONTRACTOR agrees to furnish all materials, supplies, machinery,
equipment, tools, superintendence, labor, insurance, and other items necessary
to complete said PROJECT in accordance with "Specifications" and "Description of
Work."
The CONTRACTOR agrees to commence work under this CONTRACT with FIVE (5)
consecutive calendar days of "Notice to Proceed" from OWNER and to fully complete
the PROJECT within
consecutive calendar days. CONTRACTOR agrees
to pay, as liquidated damages, the sum of TWENTY-FIVE DOLLARS ($25.00) per each
consecutive calendar day after contract date of completion.
The OWNER agrees to pay CONTRACTOR in current funds for performance of the
CONTRACT subject to additions and deductions, and to make payments in accordance
with "Specifications."
In the event the CONTRACTOR abandons the work, or fails, neglects or refuses to
continue work after TEN (10) days written notice, given to the CONTRACTOR by the
OWNER, then the OWNER shall have the option (1) to declare this CONTRACT at an end,
in which event, the OWNER shall not be liable to the CONTRACTOR for any work or

(2) to require the surety bond to be surrendered and carry out CONTRACT of
CONTRACTOR. The CONTRACTOR shall be paid for that portion of work completed
only after PROJECT is completed.
CONTRACTOR agrees to hold CITY harmless from any and all claims and demands
arising out of or connected with the performance of CONTRACTOR's obligations
hereunder, or as the result of anything claimed to be done or omitted to be done
by CONTRACTOR.
This CONTRACT shall be binding upon the heirs, representatives, successors
or assigns of the parties hereto, including the surety.
