RESOLUTION NO. 39-749

A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY
TO INSTITUTE EMINENT DOMAIN PROCEEDINGS FOR THE PURPOSE OF
CONDEMNING A SEWER LINE EASEMENT ACROSS CERTAIN PROPERTY OWNED
BY ELLIS BOGAN AND DONA BOGAN.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the City Attorney be, and he is hereby, authorized
and directed to institute eminent domain proceedings for the
purpose of condemning the sewer line easements described in
Exhibit "A" attached hereto and made a part hereof across
property owned by Ellis Bogan and Dona Bogan.

DESCRIPTION OF EASEMENT TO BE CONDEMNED:

The centerline of a twenty (20) foot wide sanitary
sewer easement across a part of the N/2, SE/4, and a
part of the SE/4, NE/4, Section 25, Township 17 North,
Range 30 West, described as beginning at a point S
00°06'45" West 195.26 feet of the Northeast Corner
of said N/2, SE/4, said Point of Beginning being on
the East boundary of said Section 25; thence North
66°36'00" West 240.50 feet; thence North 69°53'00"
West 392.00 feet; thence South 86°10'30" West 291.30
feet; thence South 82°29'00" West 250.10 feet; thence
South 48°55'30" West 161.40 feet; thence South 48°52'30"
West 389.90 feet to an existing sanitary sewer manhole
which is located 1543.20 feet West and 379.56 feet South
of the Northeast Corner of said N/2, SE/4, Section 25.
ALL of described lands being located in Fayetteville,
Washington County, Arkansas.
Also, a temporary construction easement 30 feet of
equal and uniform width located North of, adjacent
to and parallel with the above described permanent
easement.
