A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXE-
CUTE AN ARMED GUARD SECURITY AGREEMENT WITH FRONTIER AIRLINES,
INC.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute an armed guard security
agreement with Frontier Airlines, Inc. A copy of said agree-
ment, marked Exhibit "A", is attached hereto and made a part
hereof.

City of Fayetteville,
Arkansas, a Municipal Corporation and opera-
tor of the Drake Field , (hereinafter called "Airport
Operator") and FRONTIER AIRLINES, INC., c- Nevada ..orporation, (herein-
after called "Frontier") WITNESSETH:
WHEREAS Airport Operator is required by F.A.R. Part 107.4.
covering Airport Security effective February 6, 1973 and as. there- .
after amended by the Federal Aviation Administration to provide a
Law Enforcement Officer; and
WHEREAS Frontier desires to contribute toward the cost in-
curred by the Airport Operator in providing such Law Enforcement
Officer;
NOW, THEREFORE, Airport Operator and Frontier hereby apree
to the following terns and conditions:
1. Airport Operator hereby agrees to comply with
F.A.R. Part 107.4 covering Airport Security
e ffective February 6, 1973 and as thereafter
amended by the Federal Aviation Administration.
Any Law Enforcement Officers employed under
t his program will be under the Airport Opera-
t or's exclusive direction and control and the
Airport Operator assumes responsibility for their
performance on the job.
Frontier hereby agrees to pay to Airport
Operator upon receipt of invoice and Airport
Operator agrees that all previous payments made
through December 31, 1974 plus the lump sum pay-

Dollars shall constitute full and final payment
for all services provided under F.A.R. Part 107.4
through December 31, 1974.
3. Commencing January 1, 1975 and continuing
until cancelled as hereinafter provided,
Frontier agrees to pay to Airport Operator and
Airport Operator agrees to accept as Frontier's
total contribution and obligation relative to
F.A.R. Part 107.4 the following monthly amount,
payable within thirty (30) days of rec;,ipt of
invoice:
Eighteen Hundred Dollars
($1800.00 per month)
In the event of temporary interruption of
service due to labor dispute or other reasons
beyond the control of Frontier, the monthly
payment of $ 1800.00 will be reduced by 1/30th
of this amount for each day on which no
• scheduled departures occur.
4 Unless sooner terminated this Agreement shall
be for a period of three ( 3)
years, commencing January 1, 1975 and. term-
inating- December 31, 1977
In the event F.A.R. Part 107.4 is amended
in such a manner as to increase or decrease
the direct, added but of pocket expense in-
curred by the Airport Operator in order to
comply with such Amendment, the monthly
amount payable under this agreement shall
be subject to renegotiation upon request
of either party.
5 Frontier may cancel this Agreement by giving
Airport Operator Thirty (30) days written
notice upon or after the occurrence of any
one of the followincg events:
A. Revocation of F.A.R. Part 107.4
covering Airport Security.
B. Any other. program which would make
funds directly available to the Air
port Operator to cover costs incurred
under F.A.R. Part 107.4.
The order or the action of the Civil
Aeronautics Board terminating, sus-
pending or relieving Frontier's right
or obligation to operate into andfrom
said airport.
IN WITNESS WHEREOF, the parties have caused this Agreement
to be executed this 6th day of August 1995
