A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A CONTRACT WITH SAV -IT PAINT AND SUPPLY COMPANY, INC., OF SPRINGDALE,
ARKANSAS, FOR THE REHABILITATION OF A STRUCTURE AT 935 NORTH
OAKLAND. UNDER THE PROVISIONS OF THE COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute a contract in the amount
of $4,772.50 with Sav-It Paint and Supply Company, Inc., of
Springdale, Arkansas for the rehabilitation of an owner
occupied residence at 935 North Oakland under the provisions
of the Community Development Block Grant Program. A copy of
said contract, marked Exhibit "A", is attached hereto and made
a part hereof.

CONTRACT
THIS AGREEMENT is made this n7/4 day of ((l ,M%/ , 19
between the City of Fayetteville, hereafter known as "OWNER", and Sav-Tt Paint
And Supply Company
of Springdale, Arkansas , hereafter known as "CONTRACTOR".
For payments and agreements mentioned, the CONTRACTOR agrees with the OWNER
to commence and complete repairs and remodeling of structure at 935 North Oakland
City of Fayetteville, Arkansas, hereafter known as the "PROJECT", for the total
sum of 54.77?.50
. The CONTRACTOR agrees to furnish all materials,
supplies, machinery, equipment, tools, superintendence, labor, insurance, and
other items necessary to complete said project in accordance with "Specifications"
and "Description of Work."
THE CONTRACTOR agrees to commence work under this CONTRACT within FIV£ (5)
consecutive calendar days of "Notice to Proceed" from OWNER and to fully complete
the PROJECT within 60
consecutive calendar days. CONTRACTOR agrees to
pay, as liquidated damages, the sum of TWENTY-FIVE DOLLARS ($25.00) per each
consecutive calendar day after contract date of completion.
THE OWNER agrees to pay CONTRACTOR in current funds for performance of the
CONTRACT subject to additions and deductions, and to make payments in accordance
with "Specifications".
In the event the CONTRACTOR abandons the work, or fails, neglects or refuses
to continue work after TEN (10) days written notice, given to the CONTRACTOR by
the OWNER, then the OWNER shall have the option (1) to declare this CONTRACT .at
an end, in which event, the OWNER shall not hl liable to the CONTRACTOR for any
work or (2) to require the surety bond to be surrendered and carry out CONTRACT
of CONTRACTOR. The CONTRACTOR shall be paid for that portion of work completed
only after PROJECT IS completed.
This CONTRACT shall be binding upon the heirs, representatives, successors
or assigns of the parties hereto, including the surety.
IN WITNESS WHEREOF, the OWNER and CONTRACTOR have hereto set their hands
and seals respectively.

lion, as Surety are held and firmly bound unto CITY OF FAYETTEVILLE
hereinafter called the Obligee, in the sum of
FOUR THOUSAND SEVEN HUNDRED SEVENTY-TWO AND 50/100 ($ 4,772.50

for which payment said Principal and Surety bind themselves by these presents.
WHEREAS, the Principal has entered into a written contract with the Obligee dated the
21st day of

which contract and specifications are hereby referred to and made a part thereof.
NOW THEREFORE, the condition of this obligation is such, that if the said Principal shall faith-
fully perform said contract and indemnify the said Obligee from any loss, resulting from the breach
of any of the terms and conditions thereof and shall promptly pay all persons supplying labor or mate-
rial in the prosecution of the work provided for in such contract, then this obligation shall be void,
otherwise to remain in full force and effect.
