A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT WITH OZARK AIRCRAFTERS FOR DEMOLITION
OF ONE OLD BUILDING AND THE REPAIR OF ANOTHER BUILDING AT
FAYETTEVILLE MUNICIPAL AIRPORT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute an agreement with Ozark
Aircrafters for the demolition of one old building and the
repair of another building at Fayetteville Municipal Airport.
A copy of said agreement, marked Exhibit "A", is attached
hereto and made a part hereof.

AGREEMENT
THIS AGREEMENT, made and entered into this ALat

, 1975, by and between the City
o f Fayetteville, Arkansas, a municipal corporation, herein-
after called the City, and Ozark Aircrafters, a non -profit -
corporation, organized and existing under the laws of the
State of Arkansas, hereinafter called Ozark,
WITNESSETH:
WHEREAS, the City is the owner of two buildings
or hangars, located on city -owned property known as Drake
Field or the Fayetteville Municipal Airport; one of which
is described as the "old maintenance hangar" and the other
of which is known as the "old Tyson hangar", and
WHEREAS, the City has no further need for the
old maintenance hangar and desires to have the same removed

WHEREAS, it appears that certain items •of repair
need to be accomplished on the old Tyson hangar, and
WHEREAS, Ozark has need of the materials used
to construct the old maintenance hangar,
NOW, THEREFORE, for and in consideration of the
premises, and the mutual covenants and promises herein con-
tained, it is agreed between the City, acting through its
duly constituted and authorized agent, Donald L. Grimes,
City Manager, and Ozark, acting through its duly constituted
officers, as follows:
5 Ozark agrees to dismantle and remove' from the
Fayetteville Municipal Airport at no cost to the City, the
o ld maintenance hangar, and to perform the needed repairs
on the small hangar known as the old Tyson Hangar, and the

City agrees as consideration for such services to be per-
formed by Ozark, that all material dismantled and removed
from the old maintenance hangar shall become the absolute
property of Ozark, free and clear of any and all claims
of the City.
Ozark further agrees to indemnify the City and
hold it harmless from any and all claims for damages of
any nature by any of the members of Ozark, or by its agents,
servants or employees, arising from the dismantling and re-
moval of the material from the old maintenance hangar, or
the repair of the old Tyson hangar.
WITNESS the hands of the City of Fayetteville,
Arkansas, by its duly authorized City Manager, and of
Ozark Aircrafters, a non-profit corporation, by its duly
constituted and authorized officers, in duplicate originals,
of Fayetteville, Arkansas, on the day, month
and year first above written.
