A RESOLUTION AUTHORIZING THE APPLICATION FOR A LOCAL PLANNING
AND MANAGEMENT ASSISTANCE STUDY GRANT FROM THE STATE DEPARTMENT OF
PLANNING, COMMUNITY SERVICES DIVISION.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTE-
VILLE, ARKANSAS:
Section 1. That the City Manager be, and he is hereby, authorized
and directed to make application to the State Department of Planning,
Community Services Division, for a local planning and management assistance
study grant in the amount of $9,000 of which $6,000 will be available
from state funds.
Section 2. That- the Board of Directors hereby expresses its support
of and committment to the successful completion of a local planning and
management assistance study project.

Objectives and Scope
The Agency and Consultant agree that the objectives and scope
of this agreement are as described herein or by attachments, if
so noted.

Term

The term of this agreement will begin on the 21st Of April

1975 , and shall extend for a period of approximately 70
(Year)
• days and/or as agreed to separately in writing by both parties.
The initial term of a contract shall not extend beyond June 30th
of the year in which a biennium period ends. However, when it
is necessary for a contract to extend beyond a biennium period,
it is . subject to the appropriation procedure of the Legislature
and if the Legislature should disapprove the appropriation request,
then the contract is terminated at the end of the biennial period.
These contracts are subject to all of the provisions of the General
Accounting and Budgetary Procedures Law ,(Act 876 of 1973) .
A letter to the consultant from the Agency extending
the term of the agreement will be considered binding
by the Consultant and returned to the Agendy., This

Intergovernmental Personnel Grant
For work to be accomplished under this agreement, the Consultant
agrees to provide the personnel as listed below (or named on
attachment hereto) at the rates scheduled for each level of consult-
ing personnel.
The Consultant shall be paid no more than $1,000 to provide the
services set forth in the Objectives and Scope. This sum shall include
all expenses the Consultant shall be paid upon submission of invoice and
completion of services It is expressly understood and agreed that in no
event will the total compensation and reimbursement, if any, paid hereunder
exceed the sum of ne_sibioSs..

Additionally, the Consultant and the Age.ncy agree that the total
compensation exclusive of expense reimbursement to be paid the
Consultant should be approximately $ 15-000.00
Cash match of $500.00 will be provided by Consultant to the Agency.
Expense Reimbursement
The Consultant will be reimbursed for out of pocket expense as
outlined below or in accordance with the accepted standard rates
for professional consulting personnel vvhich is attached hereto and

Travel expenses will not be reimbursed in excess of $500.00
VII. Agency Responsibility
A. The Agency agrees to make available advice, counsel, data,
and personnel, etc. described immediately below or in -
attachment # to this agreement.
Advice and Counsel Only
The Agency representative who will act for the Agency in
coordinating work of the Consultant will be

VIII. Authority
A. This contract shall be Governed by the Laws of the State
of Arkanses , as interpreted by the Attorney General of the
State and shall be in accordance with intent of Section 20
Act 620 of 1969.

SCOPE OF SERVICES
The Consultant shall do, perform, and carry out in a satisfactory
manner, as determined by the Agency, the following services:
Assist the City of Mountainburg by Preparing Legal Descrip-
tions of Land to be Annexed by the City.
1) Under the direction of the Mayor, determine which parcels of
land are to be included in the area -of the proposed annexation.
2) Undertake the necessary field work to prepare accurate legal
description of the land to be annexed (the proposed new city limits).
3) Work with the Mayor and designated attorney to prepare a legal
annexation ordinance for approval or rejection by proper authorities
under law.
