A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A REVOCABLE LICENSE WITH THE UNITED STATES GOVERNMENT FOR THE NON-
FEDERAL USE OF REAL PROPERTY FOR THE PURPOSE OF MAINTAINING A SIX
INCH WATER LINE ACROSS THE FAYETTEVILLE NATIONAL CEMETARY.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute a revocable license with
the United States Government for non-federal use of real property.
A copy of said license, marked Exhibit "A", is attached hereto
and made a part hereof.

It has been brought to our attention that a City
owned 10 -inch water lino running 410 feet along tho eastern
boundary line of the Fayetteville National Cemetery, Arkansae,
encroaches approximately 12 feet inside tho Government
Property lino paralLel to Dunn Avenue. The location of
this water line has also created a drainage problem which
is undermining the retaining bank just outoido of the Cemetery
wall.
In order to properly document our real estate
records to permit this encumbrance, we have prepared and
are forwarding a Revocable License for Non -Federal une
of Real Property (No. 088-75-48) to the City for the continued
maintenance of the water lino (original and throe ooPloo)•
Please sign and date all four copies of the License.
You may retain tho original and return the remaining three
copies to this office for our official Mese
In accordance mith General Condition e. of the
Licence, DAMAGE, please tette appropriate corrective action
to restore the ground area around the pipeline to a condition
eatiefactory to the Cemetery Superintendent, Mk. John C.
Metaler, Jr., Fayetteville National Cemetery, Arkansas.

EQUAL OPPORTUNITY
CLAUSE FOR GOVERNMENT CONTRACTS
(The following clause is applicable unless this contract is
relevant orders of the Secretary of Labor (41 CFR, ch. 60).)
During the performance of this contract, the
contractor agrees as follows:
(a) The contractor willnot discriminate against
any employee or applicant for employment because
of race, color, religion, sex, or national origin. The
contractor will take affirmative action to ensure
that applicants are einployed, and that employees
are treated during employment, without regard to
their race, color, religion, sex, or national origin.
Such action shall include, but not be limited to the
following: Employment, upgrading, demotion, or
transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay or other forms
of compensation; and selection for training, in-
cluding apprenticeship. The contractor agrees to
post in conspicuous places, available to employees
and applicants for employment, notices to be pro-
vided by the contracting officer setting forth the
provisions of this equal opportunity clause.
(b) The contractor will, in all solicitations or
advertisements for employees placed by or on be-
half of the contractor, state that all qualified ap-
plicants will receive consideration for employment
without regard to race, color, religion, sex, or
national origin.
(c) The contractor will send to each labor
union or representative of workers with which he
has a collective bargaining agreement or other
contract or understanding, a notice, to be provided
by the agency contracting officer, advising the
labor union or workers' representative of the con-
tractor's commitments under this equal opportunity
clause and shall post copies of the notice in con-
spicuous places available to employees and appli-
cants for employment.
(d) The contractor will comply with all pro-
visions of Executive Order No. 11246 of Sept. 24,
1965, and of the rules, regulations, and relevant
orders of the Secretary of Labor.

No. 11246 of September 24, 1965, orby rule, reg-
ulation, or order of the Secretary of Labor, or as
otherwise provided by law.
(g) The contractor will include the provisions
of Paragraphs (a) through (g) in every subcontract
or purchase order unless exempted by rules, reg-
ulations, or orders of the Secretary of Labor issued
pursuant to Section 204 of Executive Order No. 11246
of Sept. 24, 1965, so that such provisions will be
binding upon each subcontractor or vendor. The
contractor will take such action with respect to any
subcontract or purchase order as the contracting
agency may direct as a means of enforcing such
provisions including sanctions for noncompliance:
Provided, however, That in the event the contrac-
tor becomes involved in, or is threatened with,
litigation with a subcontractor or vendor as a result
of such direction by the contracting agency, the
contractor may request the United States to enter
into such litigation to protect the interests of the
United States.

Re: The waterline running along Government Avenue on National
Cemetery property
Dear Mr. Grimes:

In field checking the location of our 6 inch waterline on
Government Avenue and the National Cemetery property as per a
survey conducted in 1949 by H.S. Peck, I find that the waterline,
a portion of the road, and the west ditch line are on National
Cemetery property.
The Veterans Administration is concerned with three things.
The locating of a water line on their property.
The location of a street on their property.
The installation of a drainage ditch on their property.
The waterline, in its closest proximity to the retaining
wall, is 8 feet and 2 inches which would place us 10.4 feet on
Cemetery property. The line varies from 10 feet at the north
end, to 25 feet 10 inches on the south end, where we turn east on
Seventh Street." They apparently have no objection to the water
main being in this location. Therefore I recommend accepting
the license agreement.
As to the location of the street on their propertylthey seem
willing to accept what is there now. The ditch seems to be the
real problem as near as I am able to determine. The ditch was
installed after the waterline. It was installed by the Street
Department. The Veterans Administration is concerned with
maintenance of the ditchbbankand with further intrusion each time
the Street Department grades the ditch. Also they are concerned
