A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXE- CUTE AN OPTION TO PURCHASE A 0.3 ACRE TRACT OF LAND FOR THE EXTENSION OF FLETCHER STREET AND FOR WATER LINE EASEMENTS. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the Mayor and City Clerk be, and they hereby are, authorized and directed to execute an option with Beulah Cook for the purchase of a 0.3 acre tract of land for the extension of Fletcher Street and for water line easements at a purchase price for said land of $5,000.00. A copy of said option, marked Exhibit "A", is attached hereto and made a part hereof. PASSED AND APPROVED THIS IPA DAY OF 1975. 7- faie> ATTEST: APPROVED: 1.44,277aveeni (It) ',CITY CLERK ..„ • a 16.02 OPTION TO PURCHASE REAL PROPERTY In consideration of One and no/I00 ($ 1.00) dollar and other good and valuable consideration, the undersigned optionor grants to the City of Fayetteville, Arkansas, a municipal corporation, hereinafter called optionee, its successors and assigns, the option to purchase the following described property: A part of Lot 4, 5, and 6 of the City Addition to the City of Fayetteville, Arkansas being more fully described as follows: Beginning at the southeast corner of Lot 4 of the said addit- ion and run thence north 36 feet thence north 260 51' west 237 feet, thence west along the south side of Center Street 67.3 feet, thence south 260 51' cast 138.4 feet, thence east 52.7 feet, thence south 100 feet, thence south 260 51' east,26.9 feet, thence east 48.6 feet to the point of beginn- ing, containing 0.30 acres more or less. Considerations Tract "A" is defined as the north half of lot 7 along with the remainder of the north half of lot 6 and any part of the southwest part of the north half of lot 5 of the City Addition to the City of Fayetteville, Washington County, Arkansas left after right-of-way dedication. Tract "8" is defined as the remainder of the Northeast portions of lot 4 and lot 5 of the City Additiou to the City of Fayetteville, Washington County, Arkansas left after right-of-way dedication. Tracts "A" and "8" would be classed by the city as a lot of record with respect to the City Zoning Regulations. The City would issue: A building permit to erect one single-family residence on Tract "A" and one single-family residence on Tract "B" if when either Center Street or the new proposed street is improved provided that structures meet all buivlaing cod 1. Dwelling is connected to a city sanitary sewer or a septic system approved by the State Board of Health. 2. Dwelling meeLs zoning setbacks from property lines and rights-of-way. 3. Curb cut will be allowed for both Tract "A" and Tract "B" as designated providing said curb cuts are 50 feet from Center Street intersection. (See plat attached hereto and made a part hereof) The City will construct at it's expense one driveway ramp base approximately"12 ft. wide of suitable material, said ramp to be constructed so as to match the finished street grades on Lots A and B. -• • Subject to the :following terms and conditions:. iOptionee may exercise this option at any time before the //July, 1975, by written notice to. optionor delivered personally, or mailed to optionor at 201 Northeast Street, Fayetteville, Arkansas, and by paying to optionor the total purchase price of Five Thousand and no/I00 ($ 5,000.00) dollars, inclusive of the consideration of one and no/I00 dollars above stated for this option. Upon due exercise of this option in payment of the purchase price of Five Thousand and no/100 ($ 5,000.00) optionor will deliver possession and title to said property to optionee, - and execute and deliver to optionee a warranty deed.'
