RESOLUTION NO. 41 -is
A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE FOR
AND THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS FOR
ALL EASEMENTS NECESSARY FOR THE CONSTRUCTION OF WATER AND SEWER
PROJECTS DHUD NO. WSF-AR-06-37-1001, AND EPA NO. WPC -Ark -329,
AND FOR THE EAST AND WEST WATER AND SEWER GROWTH AREA WATER LINE
EXTENSION PROJECTS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Manager, or his duly authorized
agent be, andris hereby, authorized and directed to negotiate
for all easements necessary to construct water and sewer projects
DHUD No. WSF-AR-06-37-1001 and EPA No. WPC -Ark -329, and to
construct the 'approved East and West water and sewer growth
area water line extension projects.
Section 2. That in the event any of the negotiations au-
thorized by Section 1 hereof are unsuccessful, the City Attorney
be, and he is hereby, authorized and directed to institute
condemnation proceedings to obtain said easements.
