A RESOLUTION REFERRING AN ORDINANCE PRESCRIBING USE CONDITIONS
FOR RETAIL LIQUOR STORES TO THE PLANNING COMMISSION FOR A PUBLIC
HEARING AND RECOMMENDATIONS.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby refers an
ordinance prescribing use conditions for retail liquor stores to
the Planning Commission for a public hearing and recommendations.
A copy of said ordinance, marked Exhibit "A", is attached hereto
and made a part hereof.

AN ORDINANCE AMENDING ARTICLE 7 of APPENDIX A TO THE FAYETTE-
VILLE CODE OF ORDINANCES BY ADDING SECTION 22 TO PRESCRIBE USE
CONDITIONS FOR RETAIL LIQUOR STORES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANAS:
Section 1. That Article 7 of Appendix A to the Fayetteville
Code of Ordinances is hereby amended by adding Section 22 to read
as follows:
Section 22. Retail Liquor Stores.
Retail liquor stores may be developed in those zoning
districts where such use is permitted, subject to the fol-
lowing conditions:
(a) No retail liquor store shall be located within
600 feet of any church, hospital or school. For the
purpose of this section, the term "school" shall in-
clude the University of Arkansas.
(b) No retail liquor store shall be located on any
property two or more sides of which abutt or are
across a street from property zoned residential (R-1,
R-2, R-3, or R-0).
(c) A view obscuring fence or hedge not less than
five feet nor more than eight feet in height shall
be erected and maintained along the common boundary
of any abutting residential property (R-1, R-2, R-3,
or R-0).
Section 2. That all ordinances or parts thereof in conflict
herewith are hereby repealed.
Section. 3. That this ordinance shall be in full force and
effect from and after the time provided by law.
