A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A MEMORANDUM OF UNDERSTANDING WITH ROY FAUBUS AND BEULAH FAUBUS
REGARDING THE DEDICATION OF STREET AND UTILITY EASEMENTS ALONG
MOORE LANE.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute a Memorandum of Understanding
with Roy Faubus and Beulah Faubus regarding the dedication of
street and utility easements along Moore Lane. A copy of said
Memorandum of Understanding, marked Exhibit "A", is attached
hereto and made a part hereof.

MEMORANDUM OF UNDERSTANDING
This agreement executed on this day of
1975, between Roy Faubus and Beulah Faubus, husband and wife, herein-
after called the "Developer" and the City of Fayetteville, herein-
after called the "City".
In consideration of the mutual covenants contained herein, it is
hereby agreed by the parties hereto:
1. The Developer agrees to dedicate a twenty-five foot street
and utility easement along the North and West sides of the
following
described property:
A part of the SE quarter of the SW quarter of Section
33, T17N, R30W, and being more particularly described as follows, to -wit:
Beginning at a point which is 331.28 feet East and 833.88 feet North of the
SW corner of said forty acre tract and running thence N 00 degrees 13'
East 156.68 feet; thence South 89 degrees 45' East 275.54 feet; thence South
00 degrees 13' {Vest 156.68 feet; thence North 89 degrees 45' West 275.54 feet
to the point of beginning.
The City agrees to measure building setback lines for all buildings
erected in the future upon the above described property from the easement
to be
line.
3. This Memorandum of Understanding shall not be construed to require the

developers to improve the existing county road (Moore Lane) abutting the North side
and West side of the property described herein.
