A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT WITH THE FAYETTEVILLE HUMANE SOCIETY
REGARDING OPERATION OF THE ANIMAL SHELTER.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute an agreement with the
Fayetteville Humane Society regarding the operation of the
animal shelder.
A copy of said agreement, marked Exhibit "A", is attached
hereto and made a part hereof.

CITY OF FAYETTEVILLE AND FAYETTEVILLE HUMANE SOCIETY

In consideration of donations to the City by the Fayetteville
Humane Society, for construction. of the original animal shelter
and for a major expansion of the shelter during 1974, the City
of Fayetteville agrees to the following rights and privileges of
Fayetteville Humane Society:
A. Fayetteville Humane Society shall have the right to occupy
and use the office facilities of said animal shelter free
of charge, as long as this agreement remains in force, for
purposes of conducting humane activities and investigation
of cases of cruelty to animals, as provided for under Ar-
kansas State Law 78-101 and the City ordinance, cooperating
with the City of Fayetteville by sharing these premises with
the humane officer during performance of animal control duties.
This office space shall be provided with a telephone and two-
way radio at the expense of the City of Fayetteville for the
mutual use of the animal control officer and the Fayetteville
• Humane Society.
B . The City of Fayetteville further agrees that Fayetteville
Humane Society shall have the use of ten kennel runs within
the animal shelter free of charge for use in holding for
placement animals which come into their custody.
C. Whoever is employed by the City of Fayetteville and is
charged with the responsibility of maintaining the shelter
facilities shall properly clean and sanitize all runs within
the shelter in accordance with standards established by
the Board of Directors of the City of Fayetteville, including
runs and cat cages used by the Humane Society, and shall pro-
vide animal food and water for all animals housed in the
shelter, including those under the custody of the Humane
Society.
D . The City of Fayetteville agrees to release into the custody
of Fayetteville Humane Society all unlicensed animals im-
pounded but not redeemed by owners within five (5) days,
whereupon the Fayetteville Humane Society shall determine
whether the animal shall be kept to be offered for adop-
tion or humanely destroyed. City of Fayetteville agrees
to humanely destroy and dispose of animals judged unfit for
adoption: Licensed animals shall be released to the Humane
Society after ten (10) days impoundment..

E . Fayetteville Humane Society shall be free to solicit donations
at the shelter from the public for adoptions of animals or
for the purpose of carrying on other humane work.
F. Fayetteville Humane Society and City of Fayetteville mu-
tually agree to keep accurate, adequate and correct records
of animals impounded within the animal shelter by the City
of Fayetteville, as well as those animals held under Humane
Society custody for the purpose of providing the public
with information and better. opportunity to redeem lost
and/or impounded pets.
G . Fayetteville Humane Society agrees to collect impoundment
fees now established or adopted in the future by ordinance
of the City, when Humane Officer is not on duty, for un-
licensed animals redeemed by owners within five (5) days
after impoundment. Owners of licensed animals shall have
ten (10) days to redeem said animals.
Animals shall not be freed to owners or others until they
are vaccinated and licensed and the boarding fee paid. The
City license fee shall also be collected by the Humane
Society where applicable. All such fees collected shall be
turned over to the City at least monthly.
H . All animals which are held in custody at the animal shelter,
whether they were impounded by the Humane Officer or
brought by the Humane Society, held beyond the five (5)
day holding period shall be charged a boarding fee now
established at 50 cents per day. If an owner is found
for the animal, he shall be asked to pay a boarding fee
from time of impoundment, as well as the license fee. City
shall have the right to withhold food for any animal held
by the Humane Society for more than ten (10) days.
Fayetteville Humane Society may hire such employees as
may be needed to carry out their work and such employees
may also use the office facilities of the animal shelter
free of charge. All such employees shall be bonded to the
extent required by the City.
J . In the event the aforementioned animal shelter is removed
to another location, or major alterations are made, the
City of Fayetteville agrees to provide the Fayetteville
Humane Society with comparable facilities, as outlined in
this agreement, in any new or remodeled animal shelter at
no cost to the Fayetteville Humane Society. In the event
of such re -location or alteration, Paragraph M of this
agreement shall not apply,

K . The Fayetteville Humane Society shall have the privilege,.
at their expense and upon approval of the City, of adding
more kennel runs or other facilities if the need arises
at any time in the future.
L . Standards for shelter maintenance, sanitation, euthanasia,
etc., shall be according to good practice.
M. Fayetteville Humane Society may terminate this agreement
at any time after giving the City of Fayetteville Thirty
(30) days notice; if such notice is given and the agree-
ment terminated, Fayetteville Humane Society shall have no
claim or recourse to money donated by them to the City of
Fayetteville for the purpose of assisting in the building
of an animal shelter. The City of Fayetteville may ter-
minate this agreement at any time after giving the Humane
Society 30 days notice. If such notice is given, the
Humane Society shall be refunded a sum of money equal to
$10,000.00 donated, less depreciation at the rate of
6-2/3% per year.
N . The term of this agreement shall be for a period of fif-
teen (15) years from the date of execution hereof.

OPERATION PROCEDURES
FAYETTEVILLE ANIMAL SHELTER

1. Fayetteville Animal Shelter shall be jointly operated by
the City of Fayetteville and the Fayetteville Humane
Society. Appropriate signs to reflect such will be erected
and maintained.
2. It is expected that the minimum hours of the Animal Control
Officer shall be from 8:00 A.M. to 4:30 P.M. Monday through
Friday, and on call after 4:30 P.M. and on Saturdays and
Sundays.
(a) Primary tasks of this employee shall be:
1. Patrol to pick up all animals which are running
at large.
Impound these animals in the shelter, feed and
water daily, including Saturdays, Sundays and
holidays.
3. Keep inside and outside premises of Animal Shelter
clean on a daily basis.
4. Destroy animals in a humane manner after im-
poundment of five days or if animals are deter-
mined to be ill and unfit fer impoundment.
5. Assist Humane Society in rdtord keeping functions,
answer phone and inquiries when necessary. Animal
Control Officer shall.supply all necessary infor-
mation to keep records.
6. Release dogs and collect fees when Humane Society
employee is not on duty.
(b) Animal Control Officer shall be provided with a radio
equipped truck. A remote station shall be located at
the Animal Shelter.
3. The Humane Society shall provide one employee to operate the
Animal Shelter office and assist the Animal Control Officer
in the overall operation of the Shelter.
(a) Hours of duty shall be by agreement between the
Humane Society and the City of Fayetteville.

(b) Primary duties shall be:
1. Answer the telephone which will be provided by
the City and dispatch Animal Control Officer by
radio.
2. Handle the public contacts made at the Shelter.
3. Work jointly with .the City to prepare and maintain
an adequate records system for dog impoundment,
dog reclaiming, funds collected and dogs destroyed.
4. Work jointly with the City to collect all fees
for licensing, vaccinating and boarding impounded
dogs for those reclaimed or placed and use proper
receipts. Turn money to City Controller at least
monthly.
5. Keep the office portion of the Shelter clean.
6. Work jointly with the City fo sell dog licenses
to owners claiming impounded dogs with owner
paying cost of license tag when taking dog
out of shelter but not receiving tag until dog
is vaccinated.
(c) All employees who handle cash shall be bonded to the
extent of $1,000.00.
4. Office shall be provided with essential furnishings and
telephone by the City. All utilities shall be paid by
the City.
5. Humane Society shall have exclusive use of the West ten
runs on the North side of the Shelter.
6. The City of Fayetteville will have authority over the
Humane Societyemployees to the extent necessary to ensure
proper functioning of the Animal Shelter; however, a dis-
tinction is to be made between the Fayetteville Animal
Shelter and the Humane Society Shelter.
7. Any questions arising that are not covered by this pro-
cedural statement shall be resolved between the Fayetteville
City Manager and,the President of the Fayetteville Humane
Society.
