A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO PETITION
THE ARKANSAS SUPREME COURT FOR LEAVE TO FILE AN AMICUS CURIAE
BRIEF IN THE APPEAL FILED BY BEAVER WATER DISTRICT FROM THE
DECISION OF THE BENTON COUNTY CHANCERY COURT IN THE CASE OF
CARROLL ELECTRIC COOPERATIVE CORPORATION V. SOUTHWESTERN
ELECTRIC POWER COMPANY AND BEAVER WATER DISTRICT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Attorney be, and he is hereby,
authorized and directed to petition the Arkansas Supreme Court
for leave to file and Amicus Curiae Brief in the appeal filed
by Beaver Water District from the decision of the Benton County
Chancery Court in the case of Carroll Electric Cooperative
Corporation v. Southwestern Electric Power Company and Beaver
Water District.
