WHEREAS, the Board^of^Directors of the City of Fayetteville, Arkansas, a municipal corporation, did cause studies to be made of the needs for street improvements on Malley Wagnon Road from Highway 16 East north to the Fayetteville city limits; and WHEREAS, pursuant to the above described studies, the Board of Directors of the City of Fayetteville, Arkansas,(haas3 received:from the City Manager certain findings and determinations, which findings and determinations are as follows, to -wit: --">-.rREPORT:ONrIMPROVEMENT."QF:.MALLEY'-WAGNONt'ROAD,FROMf': HIGHWAY"16-'EAST=NORTH TO THE`FAYETTEVILLE CITY LIMITS 1. •In acdordance•with a resolution passed and approved by the Board of Directors on August: 6, 1974; the City Manager was authorized to perform studies for the improvement of Malley Wagnon Road from Highway 16 East north to the Fayetteville city limits. 1' This resolution required a report to be made to the Board of Directors containing the following listed data: A. Determination of necessary improvements. B . Determination of the approximate cost of said improvements. C. The means available for financing said improvements. D . The portion of the cost of said improvements which the municipality is willing and able to pay. E . The approximate assessment which would be made against each lot or parcel of property. 2, The proposed street improvement should include the paving of Malley Wagnon-Road from Highway 16 East north to the Fayetteville city limits, the installation of curbs and gutters, and the installation of sidewalks; all of said improvements to meet existing city standards as set out in the Code of Ordinances and those resolutions supple- mentary thereto. 3, sidewalk north to The total estimated cost for street, curb, gutter, and construction on Malley WagnonrrRoad`from Highway 16 East the Fayetteville city limits is $13,144.45. 4. It is proposed that an assessment equivalent to the total amount of construction costs plus an amount to defray administrative, engineering, and legal fees be levied against the real property benefited by the proposed improvements. 5. It is proposed that the assessments shall be paid in successive annual installments so that the tax levied in any one year shall not exceed 25 percentum of the assessed benefits accuring to real property. 6. It is estimated that the assessments which would be made against each lot or parcel of property would approximate $13 per front foot, although assessments will not be based solely on a front foot_basis. In determining the assessments which will be levied against each lot or parcel of property, the Board will consider'every factor which will make up the sum total of benefits which each particular piece of property will receive by reason of=.the improvements. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Board of Directors agrees to establish an improvement district pursuant to the provisions of Title 20, Ch. 1-4 of the Arkansas Statutes for the purpose of making the above described improvements, if petitions are filed with the City Clerk containing the signatures of a majority in value las shown by the last county assessment) of the property to be assessed requesting that an improvement district be created for the purpose of making such improvements.
