HomeMy WebLinkAbout03-74 RESOLUTIONtt. RESOLUTION NO. 3-74 A RESOLUTION DETERMINING THE SUFFICIENCY OF A PETITION FOR REFERENDUM ON ORDINANCES NO. 1965 AND NO. 1966. Whereas, a petition for referendum on Ordinances No. 1965 and No. 1966 was filed in the office of the Fayetteville City Clerk on January 4, 1974; and Whereas, pursuant to Amendment No. 7 to the Arkansas Constitution the City Clerk made an initial determination of the sufficiency of said petition, and advised sponsors thereof that said petition was insufficient; and Whereas, pursuant to Section 2-20 of the Fayetteville Code of Ordinances, a notice of a public hearing on the sufficiency of said petition has been published in the manner and time pro- vided therein; and Whereas, the Board of Directors has examined said petition and has heard all persons who wished to be heard on the question of whether said petition is signed by the requisite number of petitioners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section. 1. That the Board of Directors hereby determines that the petition for referendum on Ordinances No. 1965 and No. 1966 is not signed by the requisite number of petitioners. Section 2. That because said.,petition is not signed by the requisite number of petitioners, the Board of Directors hereby determines that it should not order a special election to determine by a`vote of the qualified electors whether Ordinances -No. 1965 and{No. 1966 shall stand,or be revoked. 1974. • t PASSED AND APPROVED THIS /SjDAY OF ATTEST: CITY CLY APPROVED: -rue von' i!
